Show SOUTHERN UTAH NEWS - Thursday, February 12, 1381 - Pagi Seven Fredonia Firemen PUBLIC NOTICES Elect New Officers IN THE SIXTH JUDICIAL NOTICE OF INTENTION TO ESTABLISH WESTERN KANE COUNTY SPECIAL SERVICE DISTRICT NO. 1 NOTICE IS HEREBY GIVEN that on February 9. 1981, the Board of Commissioners of Kane County, Utah, adopted a resolution declaring that the public health, convenience and necessity require the establishment of a special service district in said county, to be called the Western Kane County Special Service District No. 1", for the purpose of providing garbage, fire protection, and recreational services, including, but not limited to the equipping, maintenance and operation of television transmission and relay facilities, or any one or combination of those services within the boundaries of said special service district. Said resolution also provides for a public hearing on establishment of said special service district in the Kane County Courthouse at Kanab, Utah, at 10:00 oclock a.m. on Monday, the 9th day of March, A.D. 1981. DESCRIPTION OF PROPOSED DISTRICT The boundaries proposed for said special service district are described as follows: All of Kane County, State of Utah, which lies west of the range line dividing Ranges 4 and 4'i West, Salt Lake Base and Meridian. The area includes the City of above-describe- d Kanab and the towns of Orderville, Glendale, and Alton. PROPOSED SERVICES The Western Kane County Special Service District No. 1 will be authorized to provide garbage, fire protection, and recreational services or any one or combination of them through the acquisition andor construction, operation and maintenance of such services, systems and facilities, together with the necessary appurtenances and equipment therefor. METHOD OF FINANCING Pursuant to the provisions of the Utah Special Service District Act, Sections Utah Code through Annotated (1953), as amended, and Article XIV, Section 8 of the Utah Constitution, the Western Kane County Special Service District No. 1 may impose fees and charges to pay for all o: a part of the services and facilities to be provided by said district. It may also annually levy taxes upon all taxable property within said district to provide for the proposed services and facilities, and may issue bonds for the acquisition and construction, operation and maintenance, of the facilities or systems to provide said services or facilities or to repay said bonds, must be authorized by a majority of the qualified electors of the special service district having an election for that purpose. PUBLIC HEARING ON PROPOSED ESTABLISHMENT OF SPECIAL SERVICE DISTRICT The Board of Commissioners of Kane County will hold a public hearing on the establishment of the proposed special service district and the furnishing of said services therein at 10:00 o'clock a.m. on Monday, the 9th day of March, 1981, at the Kane County Courthouse. Any interested persons may protest the establishment of the proposed Western Kane County Special Service District No. 1 or the furnishing of said services therein, either orally at the hearing, or in writing, at or at any time prior to the hearing. Written protests must be filed with the Kane County Gerk, and may be withdrawn by the protestant at any time before the Board of Commissioners establishes or abandons the special service district. Any protest signed on behalf of a corporation owning property in the proposed special service district shall be sufficient if it is signed by the president, vice president, or other duly authorized agent of the corporation. Where title to any property is held in the name of more than one person, all of the persons holding title to the property must join in the signing of the protest. At said public hearing the Board of Commis iioners will give full consideration to all protests which shall have been Bled and will hear and consider all interested persons desiring to be heard. The Commission may continue the hearing from time to time. After the conclusion of the hearing, the Commission shall adopt a resolution either establishing the Western Kane County Special Service District No. 1 or determining that the establishment of said district should be abandoned; or may, in its discretion, reduce the boundaries of the proposed district, or eliminate one or more of the proposed services, and establish said district by resolution, as modified. The boundaries of the proposed district may not be increased nor additional services added without giving of a new Notice of Intention and the holding of a new hearing. If, within fifteen (15) days after the conclusion of the hearing, over fifty per cent (50) of the qualified voters of the territory proposed to be included within the special service district file written protest with the Kane County Gerk against the establishment of the proposed district or sgainst a specified service or services, the Board of Commissioners is required by law to, in the case of the former instance, abandon the proposed establishment of said district, and in the later instance eliminate those types of services objected to. Any persons who shall, at or at any time prior to the date and time above specified for the hearing, file a written protest with the Kane County Gerk against the establishment of the Western Kane County Special Service District No. 1, or the furnishing of specified types of services within said district, and whose property has been included within the boundaries of the proposed district notwithstanding such protest, may, within thirty (30) days after the adoption of the resolution establishing the district, apply to the Sixth Judicial District Court for a writ of review of the actions of the Board of Commissioners in establishing the Western Kane County Special Service District No. 1, but only upon the grounds, however, that his property will not be benefited by the services authorized to be furnished by said district or that the proceedings taken in the establishment of the district have not been in compliance with the law. FAILURE TO APPLY FOR SUCH A WRIT OF REVIEW WITHIN THE PRESCRIBED TIME SHALL FORECLOSE ALL OWNERS OF PROPERTY WITHIN THE PROPOSED SPECIAL SERVICE DISTRICT SO ESTA- BLISHED FROM THE RIGHT FURTHER TO OBJECT THERETO. Assistant Fire Chief Mike Holmes reported that Bob Lathim had been contacted and will work with the department on fire hydrants. On being asked to become a fire member Bob declined at this time because he is involved in too many things. Bob asked that the department conserve water during training especially in the summer months. There was some discussion on getting a transmitter connected to the siren and receivers for those who have problems hearing the alarm w'hen it sounds. Three new members were accepted into the department. They are Tony Judd, Walter and James Choate. There was some discussion on the proposed constitution of the departand ment. Kanab Girl Operated On For Neck Injury Leesa Allen, daughter of Mr. and Mrs. John Allen of Kanab. underwent surgery in St. George last Wednesday for a neck fusion. She suffered a neck injury during the Christmas holidays when thrown from a horse while visiting her brother in Idaho. Leesa was taken to St. George for some skin grafting but while there were taken and it was decided the neck operation was more important at this time. The operation was successful. She is in Room 342 at the Dixie Memorial Hospital and will be several weeks recuperating from the operation.
