Show November 19, 1970 The location, width and names of all existing streets within two hundred feet of the subdivision and of all prior platted streets or other public ways, railroad and utility rights of way, parks, and other public open spaces, permanent buildings and structures, houses or permanent easements and section and corporation lines, within and adacent to the tract (e) The location of all wells, proposed, active and abandoned, and of all reservoirs within the tract and to a distance of at least one hundred feet beyond the tract boundaries (f) Existing sewers, water mains, culverts or other underground facilities within the tract and to a distance of at least one hundred feet beyond the tract boundaries, indicating pipe sizes, grades, manholes and exact location (g) Existing ditches, canals, natural drainage channels and open waterways and proposed iealignments Ih) Boundary lines of adjacent tracts of unsubdivided land, showing owner ship where possible Contour at vertical intervals not greater than five (5) feet (i) Proposed Plan. The subdivision plan shall show la) The layout of streets, showing location, widths and other dimensions , of (designated by actual or proposed names and numbers) proposed streets, crosswalks, alleys and easements. licensed professional engineer and shall be accompanied by the final county engineer plat. The shall, within a reasonable time not to exceed twenty days from the receipt of the plans, notify the subdivider of approval or disapproval, and in case of disapproval of the reasons therefor Such plans and profiles shall "'elude 1 ) The designation of limits of work to be done (2) The location of the bench mark and its true elevation according o county datum, all profiles to be referred to that datum. (3) Profiles which indicate the finished and existing grades for each side of the street Separate profiles, clearly designated, shall be made for each side of the street (d) (3) (b) tc) (d) (e) (f) (g) (h) Construction plans which include the details of curb and gutter and street cross sections, location and elevation of manholes, catch basins and storm sewers, elevations and location of fire hydrants and any other detail necessary to simplify construction 15) Complete data for field layout and office checking 16) On curb returns, at least two additional control points for elevation besides those at points of curvature Control points shall be staked in the field to insure drainage of intersections (7) The street address of the project (b) G. adus of streets shall not be in excess of eight percent on major collector streets, nor in excess of fifteen percent on other streets (c) All streets within the county shall be improved with pavements bounded by integral concrete curbs and gutters to an overall width in accordance with the standards, rules and regulations adopted by the County Commission, except for rural roads which shall be finished with a minimum of a 6 inch compacted thickness of gravel to the same section standards as above Additional gravel may be required under specif-- construction conditions (d) Pavements shall be constructed in accordance with the requirements Kane of the standards, rules and regulations adopted by the County Commission Curbs and gutters on all urban streets shall be concrete of the standard le) high back type unit, not less than two feet six inches in overall width, and not less than seven inches thick where the curb abuts the street pavement Storm water inlets and catch basins shall be provided within the (f) roadway improvements at points specified by the county engineer (g) All curb corners shall have a radius of not less than twenty four feet and at intersections involving collector or major streets of not less than twenty five feet (h) The arrangement of streets in new subdivisions shall make provision for the continuation of the existing streets in adjoinmq areas and shall providp access to unsubdivided adioininq areas insofar as such continuation or access shall be deemed necessary by the planning commission New streets must connect with existing public streets Minor streets shall approach the maior or collector streets at an (i) anqle of not less than eighty degrees Fire hydrants shall be installed in all subdivisions in accordance with (j) the regulations of the fire department (k) Open ditches or canals shall not be allowed within or adjoining a subdivision except along rear or side lot lines The subdivider shall work with irrigation, drainage or ditch companies as to 1 ) Methods of covering, realigning or eliminating ditches or canals within or adjoining the subdivision (2) The size of pipe and culverts required The layout, numbers and typical dimensions of lots Parcels of land intended to be dedicated or temporarily reserved for public use or set aside for use of property owners in the subdivision including showing dimensions where Building setback lines required by the planning commission Easements for water, sewers, drainage, utility lines and other purposes, if required by the planning commission Typical street cross sections and grade streets where required by the planning commission A tentative plan or method by which the subdivider proposes to handle storm water drainage for the subdivision Approximate radius of all center line curves on highways or streets - Where necessary, copies of any agreements with adjacent property owners relevant Approval of preliminary plat county engineer The planning commission, , and other interested county departments shall review the preliminary plat and visit the site of the proposed subdivision. Following this investigation, the planning commission shall approve the preliminary plat as submitted or modified, or disapprove the plat The planning commission hall not take action to approve or disapprove the plat until written approval is received from county each of the interested departments If the preliminary plat is approved, the planning commission shall return one copy of the plat signed by the planning commission chairman to the subdivider with any conditions countV attached Other signed copies shall be forwarded to each of the interested The planning commission shall retain one signed copy of the plat for its files departments If the preliminary plat is disapproved, the planning commission shall indicate its disapproval by distributing signed copies of the plat bearing the reasons for disapproval. The receipt of a signed copy of the approved preliminary plat shall authorize the subdivider to proceed with the preparation of the final plat. Chapter 4. FINAL PLAT The responsibility for the periodic inspection, cleaning and maintenance of such ditches, pipes and culverts In cases where canals or ditches cross public roads or proposed public roads, specifications and grades for pipe or culvert must be approved by the county engineer The subdivider shall install a six foot, nonclimable chain link fence, or its equivalent, in conformance with the standards and rules and regulations adopted a provided in section 6 1, along all open d ches, canals or waterwas, nonaccess streets, open reservoirs or bodies of water, railroad rights of way and other such features of potentia'ly hazardous nature, on crossing or contiguous to the property being subdivided, except on those features which the planning commission sta'1 determine would not be a hazard to life, or where the conforming would create a hazard to the safe!,- of the puhlic The subdivider shall install curbs gutters and sidewalks on existing and proposed urban streets in all subdivisions, except on the rear of such lots as back on maior streets not permitted access to such streets Street nac signs, cu. forming to the design and specifications and in the nun.be. provided by the standards, r '"s and regulations of the county , shall be provided by the developer at all stree' intersections Installation shall be made by th county to insure uniformity engineer Traffic control signs, including stop or yield right of way signs, shall be installed to insure a smooth flow of traffic through the subdivision as required by the county engineer A minimum center line radius of fifty (50) feet shall be naintained on a'l winding mountainus streets and a minimum of 300 feet shall be required on all through traffic streets Private streets, alleys, or ways shall not be approved except when the planning commission, after investigation, recommends and the commission, after hearing, finds that public dedication is impractical All alleys and private streets shall be improved the same as public streets (3) Final Plat 4-- The final plat must be prepared by a licensed engineer or land surveyor on a sheet of approved tracing linen with waterproof black India ink The top of the plat shall be either north or east, whichever accommodates the drawing best The plat shall contain all information required on the preliminary plat except contours and shall comply with the following (1)- . Description and delineation. The final plat shall show (a) The name of the subdivision, which name must be approved by the planning commission. fb) Accurate angular and lineal dimensions for all lines, angles and curves used to describe boundaries, streets, alleys, easements, areas to be reserved for public use and other important features (c) An identification system for all lots and blocks and names of streets Lot lines shall show dimensions in feet and hundredths. Id) True angles and distances to the nearest established street lines or official monuments, which shall be accurately described in the plat and shown by appropriate symbol. (e) Radii, internal angles, points and curvatures, tangent bearings and the length of all arcs The accurate location of all monuments and fire hydrants to be (f) installed shown by the appropriate symbol. All United States, state, county or other official bench marks, monuments or triangulation stations in or adjacent to the property, shall be preserved in precise position (g) The dedication to the county 0f a streets and highways included in the proposed subdivision (1) Street monuments shall be installed by the subdivider's engineer or land surveyor at such points designated on the final map as are approved by the county engineer Standard precast monuments will be furnished by the , county , at no cost to the subdivider and must be placed prior to the reiease of the improvement bond (h) Pipes or other such physical markers as shall be placed at each lot corner Accurate outlines and legal descriptions of any areas to be (i) dedicated or reserved for public use, with the purposes indicated thereon, and of any area to be reserved by deed or covenant for common uses of all property owners Where it is proposed that streets be constructed on property (j) controlled by a public agent or utility company, approval for the location, improvement and maintenance of such streets shall be obtained from the public agency or utility company and entered on the final plat in a form approved by the county attorney (2) (3)- . The standard forms for the following The final plat shall require (a) A registered professional engineer or land surveyorsTertificate of Survey " (b) The owner's "Certificate of Dedication " (c) A notary public's "Acknowledgement " county Id) The planning commission's "Certificate of Approval " (e) The. state board of health's "Certificate of Approval " The county engineer's (f) "Certificate of Approval " county (g) The attorneys "Certificate of Approval " (h) The commissions "Certificate of Approval " A one and one half by five inch (i) space in the lower right hand corner of the drawing for the county recorder's use The following information shall be submitted- (a) A statement that all taxes or special assessments payable on all property within the limits of the subdivision are paid in full, or a letter stating that a satisfactory bond has been filed to secure such payment (b) An itemized estimate of the cost of all proposed or required improvements, including labor and material (c) One copy of the proposed deed restrictions in final form ant) signed by all of the owners of any interest in the subdivision who sign the final subdivision map This copy shall be acknowledged by a notary public and shall be recorded in the office of the county recorder along with the final plat II) (m) (n) (o) (p) (q) (4t Water In valley subdivisions, the suivider shall submit a letter from the health department approving the quantity, quality and method of distribution prior to final commission approval (b) Mountainous subdivisions may be filed - ther as dry subdivisions or as subdivisions providing water If water is proposed to be developed, the subdivider shall submit a (c) letter from the health department as required in (a) above Id) If the subdivision is recorded as a dry subdivision, no water may be made available in any form or by any method whatsoever, nor may it be advertised to be available in any form whatsoever to any owner, visitor or prospective buyer of any lot in the subdivision until plans shall have first been approved as specified in (a) above, and evidence of having complied with these requirements shall have been filed with the commission Fences and Guards (a) In locations where a land subdivision abuts or is adjacent to public or private grazing land, a fence of material and quality satisfactory to the commission shall be erected around the outer limits of the subdivision as it is shown on the subdivision map The commission may also require the installation of cattle guards on any street entering the proposed subdivision from other existing streets (a) (5) As outlined in Section 5 1, the subdivider shall file with the county clerk a surety or cash bond in an amount specified by the commission to assure the actual construction of such improvements as have been required as a condition of approval of a subdivision plat All such improvements shall have been installed within a period of two years and shall be installed in a manner satisfactory to the commission Upon completion of the improvements for which a surety or cash bond has been filed, the subdivider shall call for inspection by the county engineer Inspections shall be made within five days from the date of the request. If inspection shows that county standards have been met in the completion of such improvements, the bonds shall be released within seven days from the time of inspection If the bonds are not released, refusal to release and the reasons therefor shall be given the subdivider in writing within seven days from the time of the inspection Chapter 6. STANDARDS Required Improvements No final plat of a subdivision of land shall be recorded, except as provided in subsection 2 2, without having been signed by the chairman of the county commission certirying that all conditions of Chapters 3 and 4 of this ordinance have been met and that the bonds as lequired by Chapter 5 2 have been posted w.di the county clerk (1) Sewers (a) Sanitary sewers, septic tanks, or any other means of waste disjaosal shall be approved by the state board of health. If a central collection system is used, it shall be constructed throughout the entire subdivision to carry off water from all inlets and catch basins, and shall be connected to an adequate outfall. A storm water drainage system subject to the approval of the county engineer shall be provided, and shall be separate and independent of the sanitary sewer system The final plans for the drainage system shall be prepared by a licensed engineer (2) Storm Drainage (a) No ditch or canal shall be approved as suitable for the use of storm drainage water without the written permission of the appropriate ditch or canal company or of the water users for such use No ditch or canal shall be used for storm water unless adequately improved to handle such water as might be reasonably expected to flow from canal and ditch water, subdivision runoff water, and other water expected to reach such canal or ditch No ditch, canal or other waterway shall be peimitted within property dedicated or to be dedicated for public use The subdivider shall remove such waterways from property to be so dedicated before the submission of the final plat (3) Street Improvements (a) At least ten do s prior to the commencement of construction, the a complete subdivider shall furnish to the . county engineer set of construction plans and profiles of all streets, existing and proposed, within the subdivision Plans are to be prepared by a Protection Strips 6-- Where subdivision streets parallel contiguous property of other owners, the subdivider may, upon approval of the planning commission, retain a protection strip not less than one foot in width between the street and adjacent property, provided, attorney has been made by the that an agreement, approved by the county subdivider, contracting to deed to the then owners of the contiguous property, the one foot or larger protection strip foi a considera'ion named in the agreement, such consideration to be not more than the fair cost of land in the protection strip, the street improvements properly chargeable to the contiguous property, plus the value of one half the land in the street at the time of agreement together with interest at a fair rate from the time of agreement until the time of the subdiv s.un of such shall be submitted by the JiotmlX contiguous property One copy of the agreement final p'at Protection attorney to the planning commission prior to approval of the boundaries of a public street strips shall not be permitted at the end of or within the or proposed street or within any area intended for future public use Chapter 7 Departmental Standards 6-- Standards for design, construction specifications, and inspection of street improvements, curbs, gutters, sidewalks, stoim drainage and flood control facilities shall be prepared , standards for water distribution and sewage disposal facilities by the county engineer by the fire department All by the board of health, and similar standards for fire hyd-an- ts subdividers shall comply with the standards established by such departments and agencies ane of the county , provided that such standards shall be approved by the County Commission . Design Standards The design c: the preliminary and final plats of the subdivision in relation to streets, blocks, lots, open spaces and other design factors snail be in harmony with design standards recommended by the planning commission and by other departments and agencies of Kane County county government Design standards shall be approved by the Commission and shall include provisions as follows (1) Blocks shall not exceed sixteen hundred feet m length (2) Blocks shall be wide enough to adequately accommodate two tiers of lots (3) Dedicated walkways through the block may be required where access is necessary to a point designated by the planning commission. Such walkways shall be a minimum of six feet in width, but may be required to be wider where determined necessary by the planning commission. T he subdivider shall surface the full width of the walkway with a concrete surface, install a chain link fence or its equal four feet high on each side and the full length of each walkway and provide, in accordance with the standards and rules and regulations, barriers at each walkway entrance to prevent the use of the walkway by any motor vehicle or by any other nonmotorized vehicle wider than four feet FEES, ENFORCEMENT, PERMITS. AND PENALTIES Fees 7-- Any and all persons filing plats with the county clerk shall pay an office checking fee according to the following schedule ( 1 ) $25 00 as a minimum checking fee for subdivisions which contain ten lots or less For subdivisions of eleven lots or more, an additional $1 00 charge (2) shall be made for each lot over ten 7 2. Enforcement The planning commission, the county engineer, and such other departments and agencies of county government as are specified under the provisions of this title are hereby designated and authorized as the agencies charged with the enforcement of the provisions of this title and shall enter such actions in court as are necessary Failure of such departments to pursue appropriate legal remedies, shall not legalize any violation of such provisions 7 3. Inspection Appropriate agencies and departments of the county shall inspect or cause to be inspected all build. ngs, fire hydrants and water supply and sewage disposal systems in the course of construction, installation or repair Excavations for fire hydrants and water and sewer mams and laterals shall not be covered or backfilled until such installation shall have been approved by the county engineer If any such installation is covered before being inspected and approved, it shall be uncovered after notice to uncover has been issued to the responsible person by the inspector The subdivider shall post an inspection fee of $400 00 with the county clerk to cover the cost ot inspections n the subdivision Upon completion of all the improvements, the county 'hall refund any amount not actually used, or, if the fund is exhausted before completion of all improvements, the subdivider shall pay the county an amount estimated by the commission to De sufficient to cover completion Permits 7-- From the time of the effective date of this ftle, the building inspector shall not grant a permit, nor shall any county officer grant any license or permit for the use of any land or the construction or alteration of any building or structure on a lot which would be in violation of any provisions of this title until a subdivision plat therefor has been recorded or approved as herein required Any license or permit issued in conflict with such provisions shall be void 7 5 Violation No person shall subdivide an tract or parcel of land located wholly or in part in the county except in compliance with the provisions of this title No person shall purchase, sell or exchange any parcel of land which is any part of a subdivision or a proposed subdivision submitted to the planning commission, nor offer for recording in the office of the county recorder, any deed conveying such parcel of land or any fee interest therein, unless such sub division has been created pursuant to and in accordance with the provisions of this title 7-- Penalty Whoever shall violate any of the provisions of this ordinance shall be guilty of a misdemeanor and, upon conviction of any such violation, shall be punishable by a fine of not more than $299 00, or by imprisonment for not more than six months, or by both such fine and imprisonment, or by the penalty for transfer and sale of property provided in section 17 27 21, Utah Code Annotated, 1953, except that in all cases where a corpora tion would be punishable as for a misdemeanor, and there is no other punishment prescribed by ordinance, such corporation is punishable by a fine not exceeding $1,000 00 This ordinance shall take effect upon its adoption and publication. Passed 1 by the Board of Commissioners 2th day of October Performance Bonds 5-- Chapter 5. IMPROVEMENTS 5-- Blocks intended for business or industrial use shall be designed specifically for such purposes with adequate space set aside for off street parking and delivery facilities (5) The lot arrangement and design shall be such that lots will provide satisfactory and desirable sites for buildings, and be properly related to topography, to the character of surrounding development and to existing requirements (6) All lots shown on the preliminary and final plats must conform to the minimum requirements o' the zoning title, if any, for the zone in which the subdivision is located, and to the minimum requirements of the late board of health for water supply and sewage disposal The minimum width for any residential building lot shall be required by the zoning title for zoned areas and shall be not less than seventy five feet at the building setback line in unzoned areas The minimum area of stale such lot shall be not less than that approved by the board of health, or that required by the zoning title, or eight thousand square feet, whichever area is largest (7) Each lot shall abut on a street shown on the subdivision plat or on an existing publicly dedicated street which has become public by right of use and which is more han twenty S'x feet wide Double frontage lots shall be prohibited except where unusual conditions make other designs undesirable (8) Side lines of lots shall be approximately at right angles, or radical to the street lines (9) In general, all remnants of lots below minimum size must be added to adjacent lots, rather than allowed to remain as unusuable parcels (10) Utility easements shall be provided to serve each lot in the subdivision Easements shall not be less than a width of 15 feet and shall be located at the rear and, as necessary, side lot lines of all lots in the subdivision The commission may require utilities to be located underground (4) (4) to the proposed subdivision shall be presented to the planning commission. 3 2.
