In each case the right of way must be obtained from the entity owning or managing the real property involved. RS2477 law gives Rights of way across federally managed land to the state and county governments for access. I think it is fortunate that the current county Commissioners did not'sign and do not intend to sign an agreement in the near future to trade these rights of way to the federal government in exchange for revokable permits under Title V of FLPMA. It is also my opinion that it would not be in the best interest of Kane County to abandon any asserted rights of way across federally managed land without first holding appropriate public meetings with proper advertisement and listing each right of way individually. The pressure to abandon a right of way should also come from the local citizens and governments and those most effected by the closure. The current Monument plan and negotiations for road closures in my opinion have not followed this procedure. 4. Litigation is something Kane County must be committed to finance on every issue. The threat of litigation is in every decision and negotiation of contracts. Judges and arbitrators help to settle disputes where two sides cannot come to agreement and without the threat of litigation the negotia- tion process is compromised. It is my opinion that if Kane County would stand by its threat to litigate when it is clearly being wronged such as with the recent monument, the federal government and its allies would not be as inclined to infringe upon Kane County and its citizens. As long as we passively sit by and compromise on every issue, then we will always be expected to compromise. Economic growth in Kane County is directly affected by the management of the federal 5. lands within its borders and surrounding counties and in northern Arizona.
