AN OD1NANCE PROVIDING FOR THE REGULATION AND CONTROL OF ALL WATERSHED AREAS BY THE CITY OF KANAB BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KANAB, UTAH: SECTION 1. The watershed area of the C,tv of Kanab, Utah, is hereby defined to be the en- tire watershed commonly known as Cave Lakes Canyon, located approximately five (5) m les north of Kanab C.ty, to the west of U. S. Highway 89 and in any canyon upstream from and within fifteen (15) m.les of any intake of the city, and vvt i 300 feet on either side of any stream or tributary where such water is taken by said City into its waterworks system for the culinary and domestic use cf the inhabitants thereof. SECTION 2. It shall be unlawful for any person to construct, use or maintain any closet, privy, outhouse, cesspool, urinal or sewage disposal system or any public bathhouse, swim- ming tank or sw'mming pool, at any place within the watershed area of said city as herein unless such closet, defined, privy, outhouse, cesspool, urinal or sewage disposal system, public bathhouse or swimming tanks are provided with effective germ destroying appliances and unless said person shall first have obtained from the City Council and the City Health Officer a permit for the construction, use and maintenance of the same. It shall be unlaw- ful for any person to break or remove any seal placed by the Health Officer, or any deputy or inspector acting under his direction, upon any privy, closet, urinal or other place where human waste is deposited or to use such place so sealed until the nuisance As abated. The and maintenance of all sewage disposal systems, cesspools, vaults, and privies shall be under the direction and supervision of the City Council and the City Health Officer. SECTION 3. (g) To wash dishes or other articles in any of said water. (j) To commit any nuisance whatsoever or to do any act that will pollute or contaminate pe-m- SECTION 6. Whenever any loose cattle, horses, sheep, hogs, or other animals are found m any stream within the watershed area of the City of Kanab, as herein defined, or within 300 feet of any stream, or shall be polluting or contaminating the water, it is hereby made the duty of the City Health Office to cause any such animals to be diven to the nearest estray pound, there any such animals to he dealt with according to law. SECTION 7. Any person vio-la- t ng any provision of this ordinance shall be punished by fine in any sum not exceeding Two Hundred Ninety-nin($299. 00) Dollars, or by imprisonment in the County Jail not longer than six months, or by both such fine and imprisonment. The court may, in imposing the fine, enter as part of the judgment that in default of the payment of the fine the defendant may be imprisoned in the County Jail for a period not exceeding six months. SECTION 8. In the opinion of the City Council, it is necessary to the peace, health, and safety to the inhabitants of the City of Kanab, that this odinance becomes effective immediately. SECTION 9. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 10. This ordinance shall take effect upon its first publication. SECTION 11. If any part of e the water. All garbage and human waste collection and disposal within watershed area of the City of Kanab, as herein defined, shall be under the direct supervision of the City Council and the City Health Officer. It shall be unlawful for any person to collect or dispose of gar- bage or human waste within the watershed area described in this ordinance without a permit from the City Health Officer. SECTION 5. All existing sew- age disposal systems, cesspools, or privies within the watershed area of the City of Kanab as herein defined, which shall be found to be unsanitary or which do not comply w.th the require ments of the city ordinances or regulations of the City Council and the City Health Officer must be remodeled and converted into a sanitary type of system within thirty days after notice to the owner thereof of such unsanitary or inadequate condition from the City Council or the City Health Office.
