WHEREAS, at a special bond election duly and lawfully called and held in Kanab City, Kane County, Utah, on July 30, 1957, there was authorized the issuance of negotiable coupon bonds of Kanab City, Kane County, Utah, in the sum of Seventy-fiv- e Thousand Dollars ($75,000) for the purpose of defraying part of the cost of improving and extending the waterworks plant and system of said city; and WHEREAS, the result of said election was declared by this City Council, sitting as a Board of canvassers, by resolution duly passed on August 5, 1957, from which it appears that the total number of votes east at said election in favor of the issuance of said bonds was 196, and that the total number of votes cast at said election against the issuance of said bonds was 74, showing a majority of 122 votes in favor of the issuance of said bonds; and WHEREAS, $65,000 of said bonds have .heretofore been offered for sale upon sealed bids and, when said bids were opened on May 27, 1958, it was discovered that the bid of- - Coughlin & Co., Inc. of Denver, Colorado, was the highest and best bid submitted for the purchase of said bonds; and WHEREAS, said bonds were on May 27, 1958, awarded to said purchaser at the price of par and accrued interest to the date of delivery plus a premium of . KANAB CITY, UTAH June 10, 1958 The City Council of K a n a b City, Kane County, Utah, met in regular public session at its .regular .meeting place in Library Building in said city, at 7:30 oclock P.M. on the 10th day of June, 1958. The following members of the City Council were present: Harman C. Steed, Mayor . Norris MacDonald, Council; man Lowell Johnson, Councilman Neil T. Crosby, Councilman William O. Knudsen, Councilman Absent:' Ernest G. Kirby There was also present Lula Robinson, City Recorder. After the meeting had been duly called to order and the minutes of the preceding meeting read and approved, the following ordinance was introduced in written form by Mayor Steed, was read in full . and pursuant to motion by Lowell Johnson and seconded by Wm. 0. ($1,000) each, numbered one (1) to sixty-fiv- e (65), inclusive, bearing interest from date until paid at the rate or rates hereinafter set out, which interest shall be payable July 1, 1959, and thereafter on the first days of January and July of each year. Said bonds shall be delivered to the purchasers as soon as they may be legally issued upon receipt by the City Treasurer of the agreed purchase price therefor. Section 6. That all ordinances and resolutions or parts thereof in conflict herewith be and the same are to the extent of such conflict hereby repealed, and after said bonds are issued, this ordinance shall be and remain irrepealable until said bonds and the interest thereon shall have been full paid, satisfied and discharged as herein provided. Section 7. That it being necessary for the immediate preservation of the peace, health and safety of Kanab City and the inhabitants thereof that the proceeds of the bonds herein authorized be available immediately for the purpose herein set forth, an emergency is hereby dclared, and this ordinance shall be in full force and effect immediately upon its adoption and publication. .
