D., 1930, FOR THE PURPOSE OF PAYING, REDEEMING and REFUNDING A LIKE AMOUNT OF WATERWORKS BONDS OF SAID CITY, DATED APRIL 1st, A. D 1920: WHEREAS, pursuant to resolution and ordinance heretofore adopted, made and entered by Hyrum City, Utah, said City duly issued and sold Dollars, ($40,000.00) Waterworks Bonds, bearing date of April 1st, A. D. 1920 , denomination $1,000.00 each, numbered from onS (1) to forty (40) both inclusive, to become due and payable on Aprit 1st, A. D., 1940, but redeemable at the option of said City on April 1st, 1930, bearing interest at the rate of six per cent per annum, payable on the first days of April and October in each year, which bonds are valid, outstanding obligations of said City, and, WHEREAS, said bonds have heretofore been called for redemption by resolution of said City Council, duly passed and approved on the 7th day of March, A. NOW, THEREFORE, BE IT ORDAINED by the City Council of Hyrum City, Utah: Section 1. That, for the purpose of paying, redeeming and refunding of Hyrum City Waterworks Bonds, dated April 1st, A. D 1S20, payable April 1st, A. D., 1940, but redeemable at the option of the said City on April 1st, A. VP (Form of Coupon) er, ;a;d City that this ordinance V which said coupons shall be consecutively numbered, beginning with Number 1, with the several dates of payment- and number of bond, and shall bear the signature of the City Treasurer, and said coupons and each of them shall be substantially the following form, April-Octob- l - City Recorder. Said bonds, each of them shall be signed by the mayor and City Treasurer and sealed with the corporate seal of the City, and the said coupons le shall bear the signature of the City Treasurer. The Mayor and City Treasurer of said City are, each, hereby empowered and directed to sign, and the City Recorder to sign and attest and affix the corporate seal of said City to each of said bonds and the acts of said Mayor, City Treasurer and City Recorder in so doing shall be the act and deed of said Hyrum City. All covenants, statements, representations and agreements contained in said bonds and coupons, and all recitals and representations of this ordinance are hereby considered and understood and it is hereby ordained and declared that said covenants and promises therein are the covenants and promises of said Hyrum City, and and statethat the representations ments therein are the representations and sfatements of said City. And it is further stated and represented that Hyrum City is a municipal corporation and a City of tHe Third Class, under the Constitution and Laws of the State of Utah. SECTION 2. The interest falling due on said bonds on the first day of October, 1930, shall he paid out- of the general fund of said City and, for the purpose of reimbursing said general fund for the payment of said interest, and for the purpose of providing for the payment of the interest falling clue on the 1st day of April, 1931, as well as .the interest falling due on the 1st day of October, 1931, there shall be levied by the City Council of said City, on all taxable property in said City, in addition to all other taxes, a direct tax in the year 930 sufficient to produce the sum of $2.505.00 ; and to meet the interest accruing on said bonds thereafter promptly and as the same becomes due, and to pay the principal of said bonds as they severally become due, there shall he levied on all taxable property in said city, in allition to all other taxes, a direct annual tax as follows : In each of the years 1931 to 194S inclusive, sufficient to produce the sum of $1,710.00 in each of said years; In the year 1949, sufficient to produce tile sum of $3,105.00, being interest $1,005.00 and principal $1,500.00. In the year 1950, sufficient to produce the sum of $4,530.00, being inter est $1,530.00 and principal $3,000.00. In the year 1951, sufficient to produce the sum of $4,350.00, being interest $1,350.00 and principal $3,000.00. In the year 1952. sufficient to produce the sum of $$4,170.00, being interest $1,170.00 and principal $3,000.00 ; In the year 1953, sufficient to produce the sum of $3,990.00, being interest $990.00 and principal $3,00.00; In the year 1954, sufficient to produce the sum of $3,810.00, being interest $810.00 and principal $3,000.00; In the year 1955, sufficient to produce the sum of $3,S30.00, being interest $630.00 and principal $3,000.00; In the year 1956, sufficient to produce the sum of $3,450.00, being interest $450.00 and principal $3,000.00; In the year 1957, sufficient to produce the sum of $3,270.00, being interest $270.00 and principal $3,000.00; In the yeyar 1958, sufficient to produce the sum of $3,090.00, being interest $90.00 and principal $3,000.00; That all of said taxes shall belevied, assessed and collected in the same manner as other general taxes are levied, assessed and collected. Said taxes, when collected, shall be applied solely for the purpose of the payment of said interest and principal of said bonds respectively and for no other purpose whatsoever until the indebtedness so contracted under this ordinand interest, shall ance, principal and have been fully paid, satisfied discharged; but nothing herein contained shall he so construed as to prevent said City from applying any other funds that may be in the City Treasury and available for the purpose, to the payment of said interest or principal, as the same respectively matures, and the levy or levies herein provided for may thereupon, to that extent, be diminished. SECTION 3. That all ordinances and resolutions, or parts of ordinances and resolutions, in conflict with the provisions hereof he, and the same are hereby, repealed, and after said bonds are issued this ordinance shall lie and remain irrepealalile until said bonds and the interest thereon shall have been fully paid, satisfied and discharged as herein provided.
