The sexton is hereby empowered to sell lots in said cemetery and to collect before occupancy all dues arising from said sales, and all moneys so collected shall be paid by him into the city treasury as often as once each month. He shall give to each purchaser a certificate of payment therefor, with a description of the lot or lots so purchased, and the Mayor of Hyrum City is hereby authorized to execute to him a good and sufficient conveyance to said lot or lots, on presentation to him of the said certificate. The price of each lot shall be determined by resolution of the City Council of the City of Hyrum. Section 4. No person shall erect a fence, corner post, or other boundary mark upon any lot or lots in said cemetery, nor grade the ground or land thereof, except under the direction of the sexton, who shall furnish the true lines of lots according to the official survey, and shall prevent and prohibit any grading, fence or boundry mark that would destroy the symmetry of the land, and which does not conform to official survey lines. Section 5. No person owning or controlling any cemetery lot shall plant or permit any shade tree or hedge to grow thereon, but he may plant and so cultivate ornamental trees and shrubs thereon, provided same are kept in trimmed and neat condition. Section 6. No person or persons shall be allowed to inter their dead in said cemetery without first obtaining from the sexton a certificate of purchase of the lot used for burial purposes, or if they do not own a lot, they shall then be required to furnish a written permit from the owner thereof, which shall be filed with the sexton, and no person shall disinter any body buried in said cemetery, unless under direction of the sexton, and before disinterment the sexton shall require a permit from the board of health and a written order from the owner of the lot authorizing such removal, which order he shall file and preserve, and all such removals shall be recorded by him in a book kept for that purpose. Section 7. It shall be unlawful for any person to shoot into, or upon the city cemetery, fence or premises, or to injure or deface any headstone, tombstone, monument, tree, shrub; or any other property. Section 9. Any person violating any of the provisions of this chapter shall be deemed guilty ef a misdemeanor, and upon conviction thereof shall be punished by a fine not less that $10.00 and not exceeding fifty dollars, or by imprisonment in the city jail not exceeding thirty days, or by both such fine and imprisonment. Section 10. That if any section, paragraph, clause or provision of this Ordinance shall be held to be invalid or unenforceable for any reason the invalidity or unenforceability of such section, paragraph, clause, or provision shall not effect any of the remaining provisions of this Ordinance. Sectin 1 . That immediately after its adoption, this Ordinance shall be signed by the Mayor and the City Clerk, shall be recorded in a book kept for that purpose, and that the same shall then be published in the South Cache Courier, a newspaper published in Hyrum, Cache County, Utah for one issue of the said newspaper, as provided by law. AND WHEREAS, in the opinion of the City Council of the said City of Hyrum, an emergency is hereby declared, and it is necessary to the peace, health and safety of the said City of Hyrum that this Ordinance shall be in effect immediately after its adoption and publication thereof. NOW THEREFORE, BE IT FURTHER ORDAINED that an emergency is hereby declared, and that this Ordinance shall be in force immediately after its adoption and publication in the said South Cache Courier for one issue thereof.
