Thus, a 40 acre subdivision with an applicable density of 5 would allow for 8 septic systems. A newly platted subdivision may, of course, already have existing structures or septic systems. Such numbers must be included in a determination ofthe overall maximum possibility. Likewise, lots previously approved for development are to be included whether or not the septic system has been installed. Lot sizes smaller than the minimum requirement may be approved, however, if the developer permanently dedicates sufficient additional acreage. In addition, it was learned, the ordinance provides for violations as a Class C misdemeanor. An in- in violation is subject to a civil penalty of up to $500 per day until the septic system is removed. If not removed within 30 days the local juris- diction may enter the site, with notice but without consent of the owner or occupant, and re-move the system. Expenses so incurred, if not reimbursed 90 days, become a lien on the property. (Stan Johnson lives in Bluff, Utah, and is a Trustee of the e Wastewater AsUtah On-Sit- sociation.) taken place.
