but noted that the legislature eliminated from the liquor bill a specific prohibition of advertising in newspapers The advertising issue "appears to be a subject solely within the jurisdiction of the legisla' ture” the board concluded The report added however that: "In this connection it is worthy of note that the three leading newspapers published in Salt Lake City do not accept for publication anywhere in this transcript that anyone ever said the commission received anything" Mr Brown said the commission contemplated action against all persons cited in the transcript as law violators adding recommendatons to the liquor commission under 14 points in a report completed Saturday Following is a full text of the report: Liquor Control Commission of Utah 375 West 2qd South City Gentlemen: The undersigned designated by you as authorized by sec- - 1 tion 33 of the Liquor Control Act to investigate complaints and charges made against (1) the commission or its officers and employes and (2) against beer licensees and (3) against others who have had dealings with the commission and with certain licensees have held hearings commencing April 28th and extending to this date duringwhich we thoroughly examined all persons we were informed possessed any information respecting either alleged violations of- the liquor control act or other unlawful or irregular practices Notice was given through the public press taf the time and place of our meetings and invitations were daily extended to everyone having information on any matter to be investigated to appear before us and all witnesses who we were told could furnish information were examined Only a few witnesses volunteered and we were forced to send out ahd bring in the greater number who were examined AH witnesses were required to testify under oath each was questioned by the three of us their testimony was taken down and transcribed by an official court reporter and the transcript of all evidence received by us is submitted to you herewith for your consideration While it is your duty and responsibility to review all of the testimony and to make your own findings and decisions we invite your particular attention to the following: (1) THE COMMISSION: Complaint was voiced to ua about the delay on the part of the commission in selecting its staff of employes in the way fixed by the legislature in section 10 of the liquor control act It was stated that while applicants for employment took examinations in May 1935 when the commission was commencing operations none has been selected for employment according to his or her examination rating Since the law provides that "no officer or employe shall be appointed or employed by the commission except as provided” in section 10 the commission must comply with the 1 - statute (2) PERSONNEL: Rumors concerning payoffs “for protection or for the issuance of draft beer licenses or other special fayors were investigated by us but no evidence was produced by others or found by uS to support any of them Some gossip sifted in to us through hearsay sources respecting alleged law violations by officers and employes of the commission but other than as herein mentioned no evidence was adduced to support such rumors (3) MARBLE MACHINES: The testimony disclosed that at least one and maybe two marble machine operators in order to secure “spots” as they call them to place their particular type of marble machines in the places of business of draft beer licensees told the latter that the liquor commission favored his or their machines One marble machine operator even went so far in dividing receipts with his customer as to first take 20 per cent “off the top” and divide only 80 per cent intimating that the 20 per cent went to some one connected with the commission Upon examination he stated that this was his way of securing tohimselfa larger split and that he did not inJactpay-an- y part of it"‘tr anyone' Since the commission has recently by resolution prohibited the placing of marble machines in thd places of business of beer licensees that action will avoid a recurrence of the “muscling in” tactics employed by machine operators claiming to have influence with the commission and will also prevent a repetition of the insinuation employed by at least of part of the reone marble machine operator that a “pay-of- f’ ceipts was made to someone We recommend that the commission strictly enforce its present regulation prohibiting the use or operation of pin or marble games slot machines punch boards and all other devices of a similar nature in the places of business of draft beer licensees We took evidence respecting charges (4) PERSONNEL made (1) that a young attorney employed part time by the commission had accepted fees for preparing for clients several applications made to the commission for draft beer licenses and (2) that he had asked draft beer licensees to use in their places of business marble machines operated by one of his clients The testimony discloses that the beer license applications were prepared by him before he was employed by the commission that no licenses were issued by the commission to any of said applicants and that one of them was later prosecuted for vio- lating the liquor law and in addition an injunction was obtained With against his place of business by the attorney in question respect to the second charge he frankly admits that he asked several draft beer licensees to permit the placing of marble machines of one of his clients in their places of business but says that they had already obtained their licenses that he had been told he could retain his private clients whose business did not conflict with his legal work for the commission and that he did not feel at the time that he was making a misuse of the influence of his position The testimony discloses that no criminality Attaches to the acts of this young man and it is our opinion that no moral turpitude was involved — although we believe his action in soliciting draft beer licensees to use his client’s machines was indiscreet under the circumstances He offers if we or the commission deem it proper to legislature can restore that prohibition In the event of flagrant or grossly offensive advertising the commission might be justified in adopting the control measures suggested in paragraph (5) hereof
