The first election will determine the It question of organizing the district. w ill entail no obligation as to bonds or otherwise for the question ef authorizing the bonds must be answered at a subsequent election. The petitions for formation of the district will be completed In a few days ready for circulation. ' Only developed land, or going con- -' corns haring distributing systems, are to be included In the new district. Any . other sections, If laming In, will have to organise Independent districts and finance themselves apart from the new district. ' This will be the esse ss to .sections of the Greater Fort Hall project. It was thought possible to form that project into one Irrigation district, but that plan has been abandoned in view of the attitude of some of the major units, including the Bancroft section, which desires a district of Its own, which will contract for about 120,000 acTS-fe- et of water from ths'Amer- lean Falls reservoir. Districts already 'organised will not be included In the big district. This Is ' the case with the New Sweden district, It has already authorised the issuance of 2260.000 ofbonde-t- o meet- - its- obligations-tthe government and Is only awaiting to as the action the big district to sell the same on a waiting market. The Snake river. Irrigation district will also vote bonds separately for that purpose. Within a few days It will be known The supreme court of Utah yeeterday denied the appeal of Nick Obllsalo from a verdict of murder In the first degree, found by a jury in the court of Harold M. Btqphens then - Judge of the Third district court, Steve Masllch, found guilty a a Obllsalo's partner In the murder of Marko La us August t, ISIS, near the mouth of Parley s canyon and almost within sight of the state prison walls paid the penalty with bla Ufa January 21 last. Obllsalos appeal was not carried to ths supreme court aa promptly as that of Masllch, and aa a result the execution of Obllsalo was delayed. Another result of the delay, however. Was that Obllsalo's csss could be considered only on the judgment roll, under law. The supreme sourt finds from that roll that the pleadings wars In proper form, snd ths proceedings bad In this csss were ably conducted In accordance with all the substantial rights Of the defendant, and In accordance with Justice and the law. The only alleged error In the Judgment roll to which ths supreme court gave attention was that In which Judge Stephens charged the Jurors ths evidence as introduced tended to connect Obllsalo with no killing except a killing in the perpetration of a robbefy and that therefore the verdict must either be guilty of murder In the first degree, aa charged, or not guilty. Attorneys for Obllsalo held that the Jurors should have been In atructed as to the various degrees of murder snd permitted to decide for themselves whether the evidence tended to show murder In the flraj degree or some ' other degree of murder. - The supreme court finds that the Utah statute provides that murder committed In the perpetration of a robbery Is murder in the first degree, and assuming that Judge Stephens' statement Is correct, to the effect that the evidence Introduced all tended to show that the killing occurred In the act of committing a robbery, then the courts instruction to the Jury waa unassailable, says the supreme Campsite te.ut.h RoadtoNew - Supreme Tribunal Upholds ' Convicton of Murder for Part in Slaying La us.
