Kearns video store have asked the Utah Supreme Court to grant a change of venue murand reduce the der charge Defense lawyers representing Charles Kenneth McCover claim first-degre- e prejudicial pretrial publicity stemming from false information fed to the media by the Salt Lake There has been no evidence to corraborate that statement was ever made the lawyers said They also point to repeated uses of such words as “brutal" and “senseless" in news stones describing the crime and claim coverage focusing on Ms Holmes’ grieving family has further prejudiced their client 's ability to receive an impartial trial The petition says the jury-selectio- n called “voir process County Sheriff's Office has dire” is insufficient to guarantee made it impossible for McCovey a fair trial The prejuto he be convicted Salt Lake Legal Defenders Andrew Valdez and Lisa Remal petitioned the justices to hear the appeal before McCovey goes to trial in 3rd District Court on Jan e 17 The lawyers are asking the high court to overturn rulings denying similar requests made by 3rd District Judge Raymond S Uno Should the justices agree to entertain the interlocutory appeal a stay would be issued postponing the trial w hile the appeal was pending who changed his McCovey name from Charles Kenneth Hodges after his arrest is charged with shooting the woman during a holdup at the Kearns Video Vovager 5448 S 4220 West The defense attorneys claim that inflammatory publicity has prejudiced the public against McCovey and that Judge Uno abused his discretion by not granting a change of venue In particular the lawyers point to statements by Sheriff Pete Hayward and some of his investigators intimating the killing was an execution and that after the shot was fired and Ms Holmes collapsed in front of her three children the bandit said “That'll take care of her" claim The negative publicity has been so pervasive that the jurors may not even know they have been tainted the lawyers claim " In a case such as this where a pregnant woman was killed in a robbery the awful drama of which has been reported continuously throughout the county how can a prospective juror really understand the way in which he or she will evaluate the evidence?” the brief asks "The bias will form an inevitable backThe prejudrop to the trial dice which permeates the potential jury pool will certainly affect the final outcome unless Mr McCovey’s motion requesting a change of venue is granted" The defense attorneys also have asked the five justices to overturn Judge Uno's denial of a motion to quash a lower court's decision ordering McCovey to stand trial for capital homicide They claim evidence presented at the preliminary hearing indicated Ms Holmes' shooting was accidental and therefore does not fit the statutory requiree ments of murder During the hearing Raymond Dari Young who drove the “getaway” car testified that McCowhen he vey was hysterical jumped into the vehicle after the robbery and told Mr Young the
