Show 4C The Salt Lake Tribune Monday January 22 199Q Lawmakers Should Shoot Down Posted Open Trespass Bill forcement officers is already working on ways to toughen criminal trespass laws There are a number of problems with a posted open trespass law In Utah which is roughly 75 percent public land it would be relatively easy to accidently wander from government land onto private property which looks exactly the same and then be issued a citation for trespass Under the current system when private land is clearly marked with painted fence posts or No trespassing signs there is little question as to where the private land boundary begins Thus there is no question that a law is being violated If landowners quit posting No Trespassing signs the trespass problem could become worse and not better Realistically most pub-li- e land users will wander on to the private land thinking it is public land Asking the federal government to post its boundaries is not realistic The Bureau of Lrnd Management alone manages 8000 miles of fence in the state Can that agency realistically be expected to post all those fencelines as being open? And with checkerboard patterns of state land intermingled with private lands is it fair to expect Utah public land users to be able to read boundaries on maps accurately? Proba- is both a Sen Richard Tempest landowner and an avid sportsman And like many ethical hunters he is concerned about the increasing number of trespass violations and vandalism on private land "Sportsmen aren't being sportsmen" he says "They are tromping over private property without taking the time to talk to the farmer or rancher Ranchers and farmers are going to close off their land and access to the public I want to get a dialogue going between the ranchers and the sportsmen" So Tempest has introduced legislation in the form of Senate Bill 45 which would create a posted open trespass law Under this legislation all land in the state would be closed to use by sportsmen or other outdoor recreation enthusiasts unless it was posted open Currently land is considered open unless it is posted closed by landowners The trespass problem is real but the posted open legislation being proposed by Tempest is definitely not the way to solve it A dialogue on trespass already exists between agricultural and sportsmen organizations Under the direction of Utah Department of Natural Resources director Dee Hansen a committee representing hunters fishermen the Division of Wildlife Resources agricultural interests and law en First the legislature should simplify the current laws to make it easier for conservation officers to enforce them Currently the process is so complicated and for the landowner so time consuming that few violators In the Outdoors are actually prosecuted Simplification should be coupled with increased enforcement especially in areas where landowners have specifically requested it Second the DWR and Department of Agriculture should work together to compile a list of landowners throughout the state which would be made available to sportsmen who wish to do the ethical thing by asking for permission This list could be made available at the clerk's office in each county Landowners would not be forced to put their names on the list but would do so in an effort to help solve the trespass problem Third more posted hunting units should be established Such organized units have clearly marked boundaries to keep sportsmen from wandering off into private land while generating revenue for farmers Fourth major sportsmen organizations like the Utah Wildlife Federation and the Utah Wildlife Leadership Coalition should establish a reward system to encourage ethical sportsmen to report acts of trespass or vandalism they see on private land By Tom Wharton Another problem with posted open legislation is actually finding who owns the property An ethical pheasant hunter for example may go into an area several weeks before a season to ask for permission to hunt on private property Chances are he will find it extremely difficult to find which farmer owns which piece of property And what about places where farm property is owned by interests? Is it realistic to expect that the 54 conservation officers in Utah will be able to enforce a posted open law which is neither understood nor supported by the general public?
