Show Progress of Howell Case. The contestee in the Hamer-Howell election case gained his first Important point Tuesday when Judge Morse refused to admit testimony to the effect that In the alleged buying of votes Will Howell ncted as the agent for his brother. Judge Howell. When this decision was rendered ren-dered Judge Powers asked that, about twenty witnesses who had been summoned sum-moned for the plaintiff be excused. Just before court adjourned Judge Powers Pow-ers asked for an order to bring In the ballot boxes. from Weber. Davis and Morgan Mor-gan counties, t'nder the decision of the court the case Is now largely one of a recount re-count as It was hoped to prove that Judge Howell was directly responsible for the briberies alleged to have been committed. Several witnesses testified that they had sold their votes, one of them declaring that when he called on Will Howell for the money the latter did not have It and got It from his brother, the Judge. The witness asserted that he signed a receipt acknowledging receiving the money for distributing cards. A rather vivid picture pic-ture of the Republican Worklngmen's club on election day was drawn by one witness, who told of large quantities of liquor consumed there. J. D. Skeen. an attorney, told that Howell How-ell had promised to see' that he succeeded succeed-ed him as Municipal Judge If he would work for Howell's election. |
