B, Pratt, editor of y the University Chronicle, were called i In thl City court yesterday afternoon. It developed that Only three of the studehts complained of were In court. J The other eight . warrants had been , served on the wrong men, who had of.? j fered themselves as substitutes for the alleged offenders. " ' f -' As these substitutes could not be prosecuted and as the Wen wanted could not be found, the-matter was deferred de-ferred until Friday and new warrants of arrest were issued for the missing eight. The court, i the prosecuting attorney and the Sheriff were amazed when but three of the men presented themselves. The roll was called three times by the clerk, but none of the others could be Induced to answer. The Sheriff was Instructed In-structed to look over the crowd of student stu-dent assembled In the courtroom, numbering num-bering near 200, to identify the others If they were there. He could find none pf them. - - Judge Diehl demanded the warrants, which upon examination showed that they had not been returned, and the court had nothing to show that the men wtre under arrest. Assistant County ' Attorney ' Bmlth wanted the missing men adjudged in contempt of court, but 8,s the men had never been arrested, this could not be done. Thereupon the court ordered new warrants drawn up and Instructed the Sheriff, to see that they were properly served.' Parley P. Chrlstensen, representing the students, requested that the defense de-fense be given until Friday to plead. ! He assured the court that the real defendants de-fendants would be on hand When wanted Friday. The case was set for the morning session of the court, which convenes at 10 o'clock. |
