expiration of H B Fol I soms term i as building Inspector Also referred 1 SALE OF CIGARETTES City Attorney McKay submitted an oMnion that the ordinance introduced at the last meeting by Councilman El liott to regulate the license and pro hibit the sale of cigarettes would be in valid if enacted for the reason that it imposes a tax on the sale of cigarettes and is not a license in the proper lgarettes sense of the term It is invalid I as a tax for the reason that the city has no ct3 power under Its charter to single out pwer tain article artcle of merchandise and Impose a tax upon i short distance dis-tance TO EXHIBIT A PUMP The Anderson Double Water Pump company through its president G G Bywater asked for privilege to tempo rarlly erect a > pumping plant on Cap itol hill on the grounds belonging to the city together with pipe line connection con-nection with City creek for the purpose pose of giving a public exhibition of anew a-new and novel invention for pumping I water I as manufacturer for malt liquors A Fisher Brewing I company i I POLICE COURT CLERK I Councilman Stewart Introduced an ordinance creating the office of police court clerk The appointment is to be made by the mayor subject to the confirmation of the council The salary is fixed at 75 per month and the clerk must be a member of the bar He must also furnish a bond of 2500 and must keep a correct account ac-count and turn all moneys over to the city treasury semimonthly A motion to suspend the rules and pass the ordinance failed 9 to 5 and the proposed measure must take its regular course Another ordinance was introduced increasing in-creasing the police force by one man THE SEWER SYSTEM i The following resolution was then j I I introduced by Councilman Buckle i Whereas To insure a complete I I success of the sewer system of this city it is an imperative necessity that there be an unlimited supply of wacer for flushing purposes which can be obtained ob-tained from the Jordan canal on Ninth East and Fifth South street therefore be it itResolved Resolved By the city council of Sal Lake city be and is hereby instructed i in-structed to notify the board o public I woiks to Immediately advertise forbids I for-bids for the construction of a main I sewer on Fifth South street from the sewer terminal on said Fifth South and Second East east on Fifth South I to Fifth East street in conformity with the estimate of the cite omrinecr marked estimate No 2 plans for the sewer to be furnished by the city I engineer juie i solution raised considerable I discussion there being some question whether there was sufficient water In the Jordan canal for such purposes Mr Buckle maintained it was a very serious matter especially for the residents resi-dents in that locality He urged the passage of the resolution The same views were taken by Mulvey and others Mr OMeara did not want a postponement post-ponement The board of public works would not meet probably for a week and in the meantime the committee on Jordan canal could Investigate the matter and i found Inexpedient report council re-port at the next meeting of the city A motion to refer the matter to the Jordan canal committee was lost and I the resolution then passed Stewart alone voting negatively Following this Mr Buckle moved for a suspension of the rules and that this ordinance be read the second and third time and placed upon its final passage When Mr Buckle made the motion he held in his hand an ordinance ordi-nance introduced during the early part of the evening by OMeara providing for the granting of a franchise to the Utah and Pacific Improvement company com-pany The motion carried without oh jeo lon and the clerk was ordered to read the ordinance The clerk proceeded to read when a storm of protests came from several members who all declared that they were under the apprehension that they voted upon the Buckle resolution re lative to the Jordan canal matter The chair thought so too and said the vote was illegal OMeara raised the point that the I chairs ruling counted for nothing and asked that the clerk read the minutes I Deputy Clerk Hull explained that Mr Buckle in his motion did not give the 1 j I title of the ordinance but as he iHM the franchise measure in his hand the clerk thought the mover referred to It and embodied it in the records so I that they showed the railroad ordinance ordi-nance was referred to In Mr Buckles I m i nfat I The fat councilman from the Third jumped up and said he did not know what he had voted on which statement I state-ment caused no surprise among the other members Stewart Diehl Callister and Romney I also stated they thought the Jordan I I canal resolution was referred to by Mr Buckle A long wrangling followed foloweI but as neither Mr OMeara or Buckle desired to take any advantage of the point the matter was finally settled by referring it over for one wepk and In the meantime have the city attorney prepare a opinion on the validity of the ordinance valdity After passing the appropriation list amounting to about 1000 the body adjourned for one week |
