Yesterday was the sixth day of the i trial of the Thiede murder case By 4 oclock in the afternoon the prosecution prosecu-tion announced they were through with the exception of the examination of one witness who owing to sickness could not be present until this morning Court then adjourned till 10 a m today to-day when after the examination of the prosecutions remaining witness which i expected to be brief the defense de-fense will open The courtroom w crowded yesterday yester-day as much a any day since the trial begnSHERIFF SHERIFF MCQUEEN recalled in reply to Judge Cherry said he had no warrant when he arrested Thiede Do you know what time the ndus trial army went down to Murray and how many there were of that organization organiza-tion 2 Objected to by Mr Howat as not proper blood marks pointed out You say there were blood stains on the linoleum on the lunch counter in the saloon Yes there was blood on the linoleum lino-leum that covered the counter What became of the linoleum I was brought down to the sheriffs office and introduced in evidence at the preliminary examination after which I believe it was brought back to the sheriffs office Have you seen it since No I have not DEPUTY MARSHAL ARCHER Deputy Marshal L L Archer was next called Mr Cherry objected to his testifying for the reason that notwithstanding not-withstanding the order of the court the witness had been present during a portion of the time that Montgomery the previous witness was being examined ex-amined Mr Archer said he didnt know of the order excluding witnesses and his honor overruled Mr Cherrys objection In the reply to Mr Howat the witness wit-ness said he had seen blood stains on an ax handle and on a stick in the brewery Did you see any blood stains on the linoleum on the lunch luncheon and on reassembling at 2 oclock Dr Ferrebee again took the stand In reply to Judge Cherry on cross examination he said he was awakened by a knocking at his door on the morn ing of the murder Thiede and the Old German Laurenberger came together to-gether Witnesss clerk opened the door and Thiede walked in to his bedroom bed-room pulled the bedclothing down and said Oh my wifes throat Is
