Show THE AGONY IS OE I The Convention Adjourn Some Extracts from the Constitution After seven days convention the Mammoth Mormon Constitutional Circus ended its labors and adjourned to meet again at the call of the President The work yesterday was merely the general clearing up and adjustment of some few important details The whole constitution was adopted bob and tail every one of the sixtysix present voting a solid Yea Only four members were absent His Young Heybourne and Anderson Mr F S Richards introduced the following fol-lowing which was carried Resolved That the President and Secretary Secre-tary of this convention address a communication communi-cation to each of the registration officers in the Territory appointed by the Utah Commission Com-mission ana whose duty it is to post notices of the general election to be held on tho first Monday in August 1887 asking them to include in their notices the statement that tho Constitution of the State of Utah will be voted upon at the said election also that similar communications be addressed to each of the county clerks asking them to post notices of said voting in each precinct on or before the 16th day of July if the registrars fail to include the desired statement state-ment in their notice and that the judges of elections of the several precincts in the Territory Ter-ritory be requested in hike manner t receive and count tho votes for and against the Constitution Booth C C Richard Sharp Wells and Jensen were appointed a committee to draft a memorial for the presenttatiop committee to carry to Washington The Secretary read the minutes a vote of thanks was given to Caine and then on motion of L Grande Young the whole thing collapsed ending for the third or fourth time the farce of making a constitution upon which Utah should be made a State Below we give a few of the most salient points ot the new constitution ARTICLE IDILL OF BIOIITS SEC 3 There shall be no union of Church and Statenor shall any Church dominate the State SEO 4 The right to worship God according accord-ing to the dictates of conscience shall never be infringed nor shall the State make any law respecting an establishment of religion or prohibiting the free exercise thereof nor shall any control of or interference with the rights of conscience be permitted No religious test or property qualifications shall bo required for any office of public trust nor for any vote at any election nor shall any person bp incompetent to testify on account ac-count of religions belief or the absence thereof SEC 5 The right of trial by jury shall remain re-main forever inviolate but the Legislasure may provide that in civil actions three I fourths of a jury may render a verdict SEC 7 Excessive bail shall not be required re-quired nor excessive fines imposed nor shall cruel or unusual punishments be inflicted in-flicted nor shall witnesses Do unreasonably detained nor confined in any room where i criminals are actually imprisoned SEO 1 Representation shall be apportioned appor-tioned according to population ARTICLE x TAXATION SEC 1 The legislature shall by law provide pro-vide for a uniform and eqcfal rate of taxation taxa-tion and shall prescribe such regulations as shall secure a just valuation for taxation of all property real personal and possessory Prodded That mines and mining claims bearing gold silver and other precious metals met-als except the surface improvements thereof there-of shal be exempt from taxation for a period pe-riod of ten years from the date of the adoption adop-tion of this constitution and thereafter may be taxed as provided by law ARTICLE XI EDUCATION SEC 2 The Legislature Jay establish free schools Provided That no sectarian or denominational doctrine shall bo taught in any school supported in whole or in part by public funds Nor shall any professor instructor or teacher be preferred employed or rejected in said schools on account of his religions faith or belief or his affiliation or sympathy with any denomination creed or sectSEC SEC 3 All legislation in regard to education educa-tion shall be impartial guaranteeing equal richta and privileges to all persons irrespective irre-spective of race color or religion SEO 5 The University shall be the University Uni-versity of this State and be under the control con-trol of the Legislature ARTICLE MISCELLANEOUS FBOVISIONg SECTION 1 The seat of government shall bo at Salt Lake City until the Legislature may otherwise determine SEC 12 Bigamy and polygamy being considered con-sidered incompatible with a republican form of government each of them is hereby forbidden IQ declared a misdemeanor misde-meanor Any person who shall violate this section shall on conviction thereof be punished by a fine of not more than one thousand dollars and imprisonment for a term not less than ab months nor more than three years in th discretion of the court This section shall be construed as operative without the the aid of legislation and the offenses prohibited pro-hibited by this section etyaH nqt bo barred by any statuto of limitation within three years after the commission of the offense nor shall tho power of pardon extend thereto until such pardon shall be approved by the President of the United States ARTICLE XVII SCHEDULE AND ELECTIONS SEC 15 This constitution shall be deemed ratified by the people of Utah if at any election to which it is submitted a majority of tho votes cast on the question of its adoption be in the affirmative SEC 16 Hons Franklin S Richards Edwin Ed-win G Woolley and William W Riter are hereby elected delegates from this convention conven-tion to proceed to Washington D C and with the Hon John T Caine delegate in Congress from Utah present this constitu toin to the President of the United States and to the Senate and House of Representatives Representa-tives in Congress assembled and urge the passage of an act of Congress admitting the State of Utah into the
