Mr. Max-wa- ll interposed a motion' for the fif the prisoner, on th ground that th affidavit en which the warrant issued did aot atata that Baker had sworn falsely upon facts matt rial to the Mr. High insisted that investigation. the affidavit was very explicit upon this point, and read therefrom to show that it charged the facts as material to which Baker had sworn falsely. He also urged that even were tbe aSdavit less particular in this respect it would suffice, since in affidavits for arrest, the same strictness required as m criminal indictments. Th Court overruled th motion, and defendant's counsel waiving au examination, bail was fixed in tbe sum of three thousand dollars for the prisoners appearance before the Third District Court at its next sitting.
