Witness had played twelve years in tlie theatre of defendant without com pensution, save a share iti the proceeds of an occasional benefit, and understood that the house was given her as a home in consider dioi i of her long services in the theatre, and in consideration of her husband having died iu the public service. She had offered defendant a payment on the house, which he refused, Site nnd her sou had made many improvements about the place, had planted an orchard, dug a wed, built a fence, dbg a cellar and added several rooms. Nothing was said by defendant about rent until witness had resided seven years in the bouse. Tin first intimation witness received that the dace wa not hers was a letter from Mr. Kad, stating his intention to iiurchase the house ot Brigham Young, on defendant he told her that he had received no such proposition froiii Mr. East. Soon after this a fetter was brought for her signature and that of her son, the letter being addressed to defend tut and proposing to give him $1,069 for the place. This she refused to sign, being unable to jmy such an amount. Witness stated that she had broken, her arm by falling down stairs at the theatre, when engaged in her duties as an actre-- s there, but that she bad never requecdeil defendant to pay the bill and did not know that be had done so until Iu (Brigham) tame to bey and told her what lie had done, a iding that , he had him, that paid the doctor mid she didn't need a dm tor, ami that she had lost a good husband by the damned ' ' ' doetors. The improvement which herself and son had put upon the place were worth between $2,090 and $15, 000. Mr. Clawson, sworn for the defense, testified that he had been connected with the theater as actor and manager since 1872. The theater had been built by Brigham Young upon an arrangement with the dramatic company that they should play gratuitously therein, the profits being applied to the purchase of costumes, scenery, etc. Defendant had formerly been President of the Dramatic Association.
