' J( When the Court had assembled, it w found that the Probate Court of Beaver county, 'disregarding the ilecis ions of the Supreme Court as well as those of the District Court, was in full blast, both grnhd and petit jurors, and engaged In civil and criminal business outside 6f its jurisdiction. The grand jury gf the Probate Court had indited two die for murder, and was about to j proceed to their trial. Under thesat circumstances, Judge McCurdy filed jn the United States Court an information of the facts and prayed for a writ of, prohibition to issue, whereupon Judge Hawley entered an order requiring J.i It. Murdock, Probate Judge of aail county, to show cause on the following morning why raid writ should not issue against him; at which time, by A. Snow, iisqn he filet! bis answer, admit-tiuall the aubstautial charges against him. Sol. P. McCurdy, for the people, made a very logical and able argument, and Mr. Snow, in behalf of the nsyond-cut- , made as good an argument as rould be made on that side of the question. The opinion of Judge Hawley, for learning and ability, was one of his best, and Jifdg McCurdy says it should be prioted and put into the hands of every person ia this Territory, and especially into the hands of Probate Judges. He concluded his argument by calling the attention wf the Probate Judge- to the fact that he had, in the face of the decision of the Supreme Court, and of the District Court, pcrsistel in assuming jurisdictional powers over chancery mid common law matters, civil and criminal; that he had done this, notwithstanding 'the Court had told him a year ago that ie had made himself personally liable fuy unwarrantable assumption; but that inasmuch as lie had disregarded these kindly warnings, he would now say to him that be had made himself criminally liable; hence the writ of prohibition was issued and served upon the Probate Judge. If ht violates it, he will be m contempt of Court; and those jwho know Judge Hawley may rest assured that, should a violation of t, writ occur, the violator will be pan- ished. r Tlie civil docketi the largest ever in that District, was wholly disposed of. The Court was greatly assisted by the great experience, learning and ability of Judge McCurdy, the U. S. District At torney. He was, we are informed, a thorough master of the law, and secured to himself great credit for the faithful manner in which he discharged his . ' duties This District Court is fast becoming one of the most important iu the TerritoryI The mining interests of that district are vry great yielding a large perml they are the most extencentage sive in the Territory. There are now some tw hundred miners there, and t&eii1 number is daily increasing. The effect of the Court in its influ ence was great upon the people. But the priesthood may do as they did last Fall, that is: barrangue the mul itnde against the Court, the Federal officers generally, and say rebellious things If they do, against the Goverumeat. they t cannot stop the waves and the tides of truth that is flowing in upon that people. Slowly but surely are the people being liberated; and they rejoice that crimes of blood, that hava been concealed and the mur s hitherto dyrers permitted to go at large, are now being brought to light and punishment. Deeds of murder that make ones blood run cold, are being brought to light, and t it is cause for rejoicing wheu Mormons are willing to come and reveal the manes of the murderers and the places of the perpetration. The day of the power of such murderers is passing and hour of tbetr punishment is near. the 1 ; ' i t j j W e Prsuts a letter from Camp Floyd, in which there Is much complaint respecting mail facilities to that ramp. We can do little more than call the attentios of the mail agent to the !! ofaffair, who will unsatisfactory doubtless look the matter. Your correspondents from this vicinity appear to be neglecting to keep you posted, so 1 will try to give you a few item of interest respecting the various parts of this District. To begin with, Eureka is fast extending; buildings, tents and cabins of various descriptions are going up in great profusion. The mines are looking first-ratEureka dlill still continues to pour forth her great wealth in hundreds and thousands of tons of the most beautiful and richest ore id: the Territory. The Eureka Company is trying to trace out the famous Emma lode, but so far those working there find nothing but a solid mass of barren lime rock, and not .he slightest possibility of attaining Ihe object of the company. The Graud Duke and Mary Ileurie.ta companies are quietly pushing forward' their work here, and all the boys trust they will retain the property now in their possession. Last week we had a little shooting on the hill, but fortunately no one was hurt, except iu pocket. The Wyoming still continues to improve as the work on the ledge is pushed forward. Ihe owners. Tease, Taylor and are determined Boyd, this one of the best mines upon proving in the Territory, of which it at present giies every indication. Tins mine null lie wonderfully easy to work, as the ledge is of great width and traceable for Inmilrt ds of feet on the surface. It situated ou a small hill and away from every other location, thereby rendering it free from all litigation and disputes which 'is now considered a very important item in this district. Silver City is just now quite excited over one or two new discoveries which ore showing first rate; amongst which may be named the Grccu Sleeve, the Blue Gown, Mountain Hue, Wasmer, Cliuta and Galena Belle. These, with the mines already developed, will make Silver one of the most prominent camps in the Territory, The Black Dragon, Sunbeam and r few other mines, still attract considerable attention. Diamond also is progressing rapidly with mills and furnaces and one or two good mines. .The Swansea, belonging to Crixumn St Mender, is also a first class mine; from which is being extracted first class ore. Last, but not least, comes the Mammoth, from which e, pieces of pure native copper are being takeu daily. This is beyond a doubt the best and largest copjicr mine ever Junius. yet discovered. Not being one of the Grand Jury, now ia session, and in no way connected with the courts of law, I am not supposed neither do I know if Brigham Young, or any others of the High Priesthood of Zion have been in dieted for murder or any other high crimes. Here we have undoubtedly the largest and by far the richest and best defined lodes of fine milling ore in the Territory, with resident population of 200 persons; and no means of communication with the outside world, except we delegate some one to take our mail to adjoining towns; and then the loved ones at borne sometimes write us, and it Is a great consolation to be able to receive turh communications before they gtt cold. The London Telegraph of the 19ili says, editorially, there is no longer much room to doubt that to the misfortune of a deficient harvest will be added the disaster of the cattle plague, the foot and inouih disease spreading among horned stock of the kingdom with deplorable Hunting rapidity. Northamptonshire, donshire and Cambridgeshire arc the three English counties chiefly affected. It has spread as far north as Perthshire. To give a clearer idea of its ravages, in the city of Preston there were up to Saturday lost 4,870 cattle attacked. It has already spread over 73 British counties and is also spreading in Ireland. The number of animals suffering is estimated at 23,000, but the pest involves also sheep and swine. Besides this disease the pneumoniabas also appeared, and this deadly malady is ravaging herds in 31 counties in England and 13 in Scotland, and has even extended into Ireland. Berne, SepL 29.
