BUTTERFIELD, TT FOH HAU3 f - to-da- ! tu When that time arrives let the other business and go over, and let the whole-othat week be devoted to criminal matters, aud as long thereafter as may be necessary in order to close up the criminal business on the docket. McKean, Ch. J. What do counsel say to that? . Mr, Hempstead If your Honor please, m view of all the magnitude of this case and the circumstances surrounding if, the number of counts iu the indictment, the very large number of witueses, to which additions have just been made, numbering upwards of sixty I think, we desire time to prepare for the trial of this case under this particular statute. And while the question comes up nfore particularly now upon the first case on the docket, we should like the case to go over for the term if that i practicable. We feel that we ought to have suflicieut time to prepare this case in justice to ourselves, iu justice to th defendant, in justice to everything that surrounds u, and we would like the case to go over to the March term, which is not an unusual thing to be asked for in cases of magnitude. We do not think it is unusual in a case of this character. Without dwelling upon the many mat ter which can occur to the counsels minds, which will occur to courn-eupon the other aide a well ns to the Court, we ask that the case may be continued until th March term of tlie Court, in order that ue may pre pare to meet it a its magnitude and the questions involved deserve and are entitled to be met. McKean, C. J. It is right that there should be ample time lo prepare, but counsel ure aware of the fact that wc have been in the habit, at the universal request ot tho Bar, to hold adjourned term. I have held, many more than the regular term by adjournment, and there is other business pressing for the present, and it is quite probable, gentlemen, that 1 can make such arrangements after disposing of some more of this business and seeing how much time it takes it is quite probable that I can make such arsangcmer.U ns would bo mutually satisfactory at some futireday, and give you on both sides ample time for preparation. , Mr. Baskin I will say, may it please your Honor, that I ain perfectly willing anti it is right that every person before the Courri charged with crime bhould have ample time to prepare their j case, aud that while I am ready to consent to a reasonable time, yet if it is to go over to the ext term 1 will have to nk them to prepare the necessary papers for that purpose. McKean, Ch. J. I do not now, gentlemen, rule upon that question ; I simply say that 1 think I can make such afler disposing of the business now on the docket, as will please all pirtie., Mr. Hempstead We have no doubt of that, your Honor, aud therefore 1 have not prepared the papers. We hare, more or le.f civil business which is hanging, which necessarily takes time, a great deal of our time ; your Honor understand that, and 1 am sure will 11 Han-Diego- di-ast- YtliSQXAm d l who e-rul i y vCp.-tlm- THE LATEST pomIi B.
