The state intended to lay the new road over the dry lake bed laid bare when the lake relicted, or went dry, atop the land in question. The Hardy Salt Company, which produces salt by evaporating water pumped from the lake, disputed the claim of one state to the land, and, in 1968, was sued by the state. Judge D; Frank Wilkins of the Third District Court held, in' July of this year, that the land really belongs to the state after all. The whole mess started in January 1896 when Utah obtained statehood, and along with it the title to the bed of the Great Salt Lake, which was a navigable body of water at the time Utah became a state. The original level of the lake was measured and recorded in 1850, a year after Brigham Young and his band had emigrated to Salt Lake City. At that time the level known as the Meander Line was defined. By 1890, the lake level had dropped four feet, and by 1968 was five and one-hafeet below the Meander Line. Meanwhile, Hardy moved in and began operations on dry land, which, it seems, was below the 1850 Meander Line. The court held that the lake was still navigable when statehood was conferred, and thus Hardy had really bought the proverbial Brooklyn Bridge and a fat law suit when the state decided that a super highway should pass around that south corner of the lake in order that those thousands of eager tourists could barrel out of Salt Lake City toward the mecca of LEWISORBROS.
