Constitution and the first, short-live- d territorial constitution of Utah. That principle, said the governor; That the legislature make the laws, the executive branch carries them out, and the Judiciary adjudicates disputes each branch of the government acts as a check and balance upon the other. Said Governor Rampton: The phrase "checks and balances has been thrown about with a careless disregard for the original meaning by people who should know better. He suggested that Utahns their history books and learn that checks and balances means "between branches of government, not within branches of government. The founders of die nation, said the governor, knew that authority and responsibility within a department had to be definite. Governor Rampton scored against still another of the arguments against the contents of die Commission report: He said that "One of the most illogical of arguments is that a gain of efficiency will automatically mean a loss of democracy. Governor Rampton refuses to accept the idea that Utah must accept waste of taxpayers money as the price for a Democratic System of Government. He endorsed the Commission proposal that the Coordinating Council of Higher Education be restored....but that the Council reconstituted as a Board of Higher Education, be without the former adverse characteristics. He endorsed the opposition to having members of the institutions of higher learning on the Board because of the pressures they would apply. Governor Rampton urged an, early development by the Board of Higher Education of a statewide master plan for higher education. He warned that "we are doing the taxpayers and the young people of Utah a terrible disservice if we let our desire to build bigger institutions bleed away our capacity to provide quality education for the citizens of this state. He delcared it to be of "greatest importance to our people that the central agency of the state in higher education be given both responsibility and authority to match the demands we are placing upon it. Earlier Tuesday, the Little Hoover Commission report came m for another conflict with the Attorney General, Phil L. Hansen. Mr. Hansen cast a "no vote against a Board of Examiners approval for expenditures of $96,400 for detailed studies of the State Department of Highways and the State Department of Education. The studies involve federal funds program and were contemplated to supplement die work of the Hoover Commission. Mr. Hansen argued that the studies were planned to refute the findings of the Hoover Commission. He later Issued a press release in which he declared that "a floodgate was opened Tuesday that could cost the people of Utah millions of dollars in expenses that have not been approved by the legis- ine self-inter- lature.
