This, Mr, Cluff positively refused, but reported back that he would be willing to quit with good feelings, if the doctor wanted to ''dismiss the action and call the whole thing off. This latter preposition was finally accepted by the doctor and acting upon- - stipulation to that effect. Judge Morgan has entered an order dismissing the case w ithout any Judgment or costa against either party, which of course means that the doctor is out his costs eady-paid the action, and in brining his witnesses down from Salt Lake to the trial before Justice Jones.
