BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF PROVO CITY, UTAH:: SECTION 1. It shall be unlawful unlaw-ful for any person, whether as principal or agent, clerk or employee, em-ployee, either for himself or for any other person, or for anybody Corporate, or as an officer of any corporation, or otherwise, to commence com-mence or carry on any business, tra.de. calling, profession or occupation occu-pation in this ordinance specified in Provo City, without first having hav-ing procured a license from said City so to do, or wit'hout complying comply-ing with any other regulatory ordinance now existing, or hereafter here-after to be adopted by the Commissioners Com-missioners of Provo City, or without with-out complying with any and all regulations of such business, trade, calling, profession or occupation, contained in this ordinance; and the carrying on of any business, trade, calling, profession or occupation oc-cupation mentioned in this ordinance ordin-ance without first having procured a license from said city to do so, or without complying with any and all regulations of such business, busi-ness, trade, calling, profession or occupation contained in this ordinance, or-dinance, shall constitute a separate violation of this ordinance for each and every day that such business, trade, calling, profession or occupation is so. carried, on. SECTION 2. The amount of any license imposed by this ordinance shall be deemed a debt to Provo City, and any person, firm, or corporation carrying on any business, busi-ness, trade, calling, profession or occupation mentioned in this ordinance or-dinance without having a- license from said city so to do, shall be liable to an action in the name of said city in any court of competent com-petent jurisdiction, for the amount of license by this ordinance imposed im-posed on such business, trade, calling, call-ing, profession or occupation. i SECTION 3. It shall be the duty of the City Recorder to prepare pre-pare and isfue a license under this ordinance for every person, firm, or corporation liable to pay a license li-cense hereunder and to state in each license, the period of time covered thereby, the name of the person, firm or corporation to whom issued, the business, trade, calling, profession or occupation licensed and the location, or place of business where such business, trade, calling, profession or occupation occu-pation is to be carried on. All such licenses shall be signed by the Mayor of Provo City and attested at-tested by the City Recorder. The City Recorder shall make a charge of one dollar for each duplicate license issued to'replace any license issued under the provisions pro-visions of this ' ordinance which has been lost or. destroyed. In no case shall any mistake made by the City Recorder in stating the amount of a license prevent or prejudice the collection by the city of what shall be actually due from any one carrying on a business, busi-ness, trade, calling, profession or occupation, subject to a license under this ordinance. SECTION 4. All licenses shall be paid in advance, in legal cur rency of the United States, at the! office of the City Treasurer; provided, pro-vided, however, that the licenses required to be paid by the provisions provis-ions of this ordinance shall be due and payable on and after the first day of January, 1937. A separate license must be obtained ob-tained ,for each branch establishment, establish-ment, or separate place of business, busi-ness, in which the business, trade, calling, profession, or occupation is carried on, and for each separate sep-arate kind of business, trade, calling, profession, or occupation, and each license s'hall authorize the party obtaining it to carry on, pursue, or conduct only that business, busi-ness, trade, calling, profession or occupation described in"such license, li-cense, and only at the location ctr place of business which is indi- cated thereby, provided, further, that where a license is hereby imposed im-posed upon any business, profes sion, trade or occupation, and the i number of persons employed or the gross receipts of such business is made the basis for fixing the amount of such license, a separate license tax shall be paid for each branch establishment or place of business in which the business, trade, calling or occupation is carried car-ried on, based upon the number of persons employed in, or on the gross receipts of each such branch establishment or separate place of business. The monthly license in this ordinance or-dinance provided shall be due and payable to the City on the first of each month, in advance, from all persons who have for the previous pre-vious month been licensed to carry on the same business, trade, calling, call-ing, profession or occupation, and from all persons who have not been licensed for the previous I month for the same business, trade, calling, profession or occupation, occu-pation, the license shall be due and payable and must be procured by such persons before commenc ing: to carry on such business, " - "r " I traue, caiung, P'w.. -, pation. 1UC . ordinance provided shall be due and payable to the city on the first day of January, April, July and October, and all such licenses shall expire with the last day of March, June, September and December De-cember of each year, but the first quarterly license issued to any person, as herein provided shall be issued for the unexpired one-third one-third or two-thirds of the current quarter; and the amount to be paid therefor shall be prorated for the said unexpired one-third or two-thirds of such current quarter. The daily licenses in this ordinance ordin-ance provided shall be due and payable to the City each day in advance. The semi-annual licenses in this ordinance provided shall be due and payable to the cityat the time!PeC!C or when not so specified on the first day of January and July of each year, but the first semi-annual license issued to any person as herein provided shall be issued for the unexpired even monthly portion of such half year, except as herein otherwise in this ordinance ordin-ance specifically provided and the amount to be paid therefor shall be prorated for the said unexpired unex-pired even monthly portion of such half year. Every person, firm or corporation having a license under the provisions of this , ordinance, or-dinance, .and carrying on a business, busi-ness, trade, calling, profession, or occupation at a fixed place ox business, shall keep such license posted and exhibited- while in force, in some conspicuous part of said place of business. Every person having such a license, and not having a fixed place of business, busi-ness, shall carry such license with him at all times while carrying on the trade, calling, profession or occupation for which the same was granted. Every person, firm or corporation having a license under the provisions of this ordinance or-dinance shall produce and exhibit the same, when applying for a renewal re-newal thereof, and whenever re quested to do so by any police officer, or by any officer author- IzedXtO issue, inspect or collect licenses. SECTION 6. All police officers are hereby appointed inspectors of licenses, and in addition to their several duties as police officers, are hereby required to examine all places of business and persons in their respective beats liable to pay a license, and to see that such licenses are taken out, and shall have and exercise the power: 1st, to make arrests for the violation of any of the provisions of this ordinance; 2nd, to enter free of charge, at j annual or annual licenses remain-iv remain-iv time. anV place of business 1 msr wmaid a nenaltv of ten ner- any time, any place for which a license is required by -this ordinance and to demands the exhibition of such license for the current term by any person engaged en-gaged or employed- in the transaction trans-action of such business and if such person shall then and there fail to exhibit such license, such person per-son shall be liable to the penalty provided for a violation of this ordinance. It is hereby made the duty of the police officers to cause complaint com-plaint to be filed against all persons per-sons violating any of the provisions provis-ions of this ordinance. The Chief of Police is hereby directed to carry into effect the provisions of this section. SECTION 7. The conviction and punishment of any person for transacting any business, trade, calling, profession or occupation without a license, shall not excuse or exempt such person from the payment of any license due or unpaid at the time of such conviction, con-viction, and nothing herein shall prevent a criminal prosecution for any violation of the provisions of this ordinance. SECTION 8. In all cases where the amount of license to ' be paid by any person, firm or corporation is based upon the amount of re- ctipts or sales or of business trans acted, or upon the number of per-1. employed or uoon the nuii'rrovwed, this tax does not apply of Wagons or other vehicles -.used, or unon the mount of the . maximum admission fee charged, or upon the number of tables used for any game, or upon the number of rooms in any building, such person, firm or corporation shall, before obtaining a license for his, their or its business, render to the City Recorder for his guidance in ascertaining the amount of license li-cense to be paid by such person, firm or corporation, a written statement sworn to before some officer authorized to administer oaths, showing the total amount of receipts or sales or of business transacted during the license period next preceding the date of such statement or the average daily number of persons employed by such person, firm or corporation corpora-tion during the license period next preceding the date of such state- m . , vehicles used or the amount of the maximum admis sion fee charged, or the number of tables used for any game by such person, firm or corporation, or the number of rooms, contained in such building at the date of such statement. No such affidavit shall be conclusive con-clusive upon Provo City, or upon any officer thereof, as to the matters therein set forth, and the same shall not prejudice the right of the said city to recover any amount that may be ascertained ascer-tained to be due from such person, per-son, firm or corporation in addition addi-tion to the amount shown by such statement to be found to be incorrect. in-correct. SECTION 9. In any case where the first license is to be issued for a newly established business no statement need be made, at the time such first license is issued, of the amount of receipts or sales or htsiness transacted, and the minimum rate nerein prescribed shall be paid at the time such first license is issued for any such newly established business the amount of license for which is regulated by the amount of re ceipts or sales or business trans acted. SECTION 10. The City Recorder Record-er at the close of business on any day on which a daily license shall be required, shall add to each such daily license remaining unpaid at such time a penalty of ten percent per-cent of the amounts of such delinquent de-linquent daily license; provided, however, that ; when the day of which such license is required falls on a Sunday or a holiday such penalty shall be added to each such delinquent daily license at the close of business on the last business day preceding such Sunday Sun-day or holiday. The City Recorder shall, at the close of business on the tenth day of every month, add to all monthly month-ly licenses remaining unpaid a penalty of ten percent on each delinquent monthly license; the City Recorder shall, at the cle of business on the thirtieth day of the first month in which any quarterly license may be due, add to .all such quarterly licenses remaining unpaid a penalty of ten percent on each delinquent quarterly license remaining unpaid; un-paid; the City Recorder shall, at the close of business- on the last day of the second month in whichj any semi-annual or annual license mav be due. add to all such semi ing unpaid a penalty of ten per cent on each delinquent semiannual semi-annual and annual license and fc'hall enter the same upon his books and deliver the same to the City Treasurer. SECTION 11. RATES OF LICENSE ESTABLISHED. The rates of licenses for the businesses, professions, trades, callings or occupations herein named shall be, and the same are hereby fixed and established for and within Provo City, according to the following schedule, and the same shall be paid by all persons, firms, or corporations engaged in such businesses, professions, trades, callings and occupations, as follows, to-wit: 11 x 1. The provisions of this ordinance shall not be deemed or construed to require the payment pay-ment of a license to conduct, man- age or carry on any business, occupation oc-cupation or activity, from any institution or organization which is conducted, managed or carried on wholly for the benefit of charitable char-itable purposes or from whidh profit pro-fit is not derived, either directly or indirectly, by any individual firm or corporation;, nor shall the payment of a license be required for the conducting of any entertainment, enter-tainment, concert, exhibition or lecture on scientific, historical, lit-' erary, religious or moral subjects, sub-jects, whenever the receipts of any such entertainment, concert, exhibition or lecture are to be appropriated ap-propriated to any church or school, or to any religious or benevolent be-nevolent purpose within the City of Provor nor shall; the payment of a license be required for the conducting of any entertainment dance, concert, exhibition .or lecture lec-ture by any religious, charitable, fraternal, educational, military,! Section 13. No refund shall be made on any license issued In accordance ac-cordance with the provisions of this ordinance, unless the conducting, con-ducting, managing or carrying on of such business a provided in such license shall become unlawful, unlaw-ful, either by act of tne City Com- , missioners, or by act of some other legislative body having jurisdiction juris-diction therein, or when payments thereon have been erroneously made by the licensee. Section 14. Violation of any of th6 provisions 01 this ordinance shall constitute a misdemeanor, and any person convicted of such violation and misdemeanor shall be punished by a fine not exceeding exceed-ing $299.00, or Imprisonment for a term not exceeding three (3) months in the city jail, or both such fine or imprisonment. Each member of a firm violating any of tne provisions of this ordinance shall be termed as guilty as an Individual. That all ordinances, in conflict with this ordinance be, and the same are hereby repealed, . provided that any such repeal shall net affect or prevent the prosecu--tlon and punishment of any. per-J son, firm or corporation for any-act any-act done or committed in violation of any ordinance which may be repealed by this ordinance, and. shall not affect any .prosecution of action which may be pending in any court for the violation of any ordinance, repealed by this ordinance, and provided, further, that the licenses required to be paid by the provisions of said ordinances shall be paid by every person,, firm and corporation, sub-, ject thereto up to and until Janu- . ary 1, 1937. Ordinance, dated November 25, 1935, relating to licenses for sales of beer is not hereby repealed. Section 16. If any eection, sub-sectiotl, sub-sectiotl, sentence" clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, unconstitu-tional, . such decision shall not affect af-fect the validity of the remaining portions of the ordinance.
