Show NOTICE OF TRUSTEE'S SALE. Whereas, Charles August Allen and Eion L, Alien, his wife, of Utah Countv, Utah, executed, exe-cuted, acknowledged, and delivered to James H. Bacon, trustee, their certain trust deed, beariDg date the first day of December. A. D. 1890, which said trust deed was recorded in the recorder's office of Utah County, Utah, in Book '-8" of Trust Deeds, on paires 228, 229, 230 and 231 of the reoords cf said office, and given to secure se-cure tho payment of Twenty-two Hundred Dollars, as evidenced by a certain first mortgage bond or n-ite, bearing even date with said trust deed, and payable on the first day of December, A. Also one-fourth of the water in the Pond "own Slough, togetherwith any and all water rights owned by tho said Charlee August Allen and Elon L. Allen, or either of them, or belonging to or with or used upon said premises, or any part thereof. And Whereas, it is provided in said trust deed among other things that in case default be made in the payment of either of said notes, indebtedness, or moneys secured bv said trust deed, or of the taea or assessments on said premises or any part thereof, or in case of the breach of any of the covenants in said trust deed contained to be kept and performpd bv the said Charles August Allen and Elon l., Allen, then to sell and dispose of said premises, prem-ises, or any part thereof, and said water rigiits, togetner with all the right, title, benefit bene-fit and equity of redemption of the said Charles August Allen and Elon L a Hen, their heirs and assigns therein forever, either in mass or in separate parcels, as the holder or holders of said bond and notes may prefer, at public auction, at the front door of t je Court House in the County of Utah and Territory cf Utah, or on said premises, as may be specified in the notice of 6uch sale for the highest and best price the same wi'l bring in cash, after first giving tnirty days previous notice ot such sale by publication in any newspaper at that time published in the said County of Utah.and to make, execute, acknow;edge and deliver to tho purchaser or purchasers at. said sale good I and sufficient deed or deeds of conveyance for the premises sold. -And Wher as, it is aiso provided in said trust deed, among other things, that in case default be made in the pay ment of any or either of the indebtedness or moneys secured thereby-whether thereby-whether of principal or interest, or f the breach of any of the covenants in said trust deed contained, to be kept and performed bv the said Charles August Allen and ElonL. Allen, then any and all of the moneys thereby there-by secured shall upon such default, at the option of the holder of said indebtedness, become be-come immediately jue and pavable, any thing in eaid trust deed or in said bond or notes contained to the contrary, notwithstanding. And Whereas, Charles August Allen and Elon L. Allen have both and each made default in the payment of the interest on said indebtedness, due on the first day of December, A D. 1893; on the first day of June, A.D, I8fl;and on the first dav of December, A. D. 1894; nnd Whereas, tne legal holder of said indebtedness indebted-ness has declared the whole ot said indebtedness indebted-ness to be now immediately due and payable and requested said trustee to advertise and sell said premises and water rights, pursuant to tho power and authority in him vested in and by said trust deed ; and Whereas, it is also providsd in said trust deed that in case of the death, absence from said Utah County, inability or refusal to act ol the said James H. Bacon, that then Harvey M. Bacon shall be and is by said- trust deed appointed and made successor in trust to said James n. Bcon,with like powers tad authority, author-ity, and said premises thereuprn becomes vested in said successor intrust, for thouHes and purposes in said trust deed mentioned; and Whereas, ea'd James H, Bacon is absent , from said Utah County, unable to and refuses to act in the premises. Now therefore public notice is hereby given that I, Harvey M. Bacon, successor in trust as aforesaid, will on Thursday, the 21stday of February, A.D. 1895, at ten o'clock a m. of said day at the north frontdoor of the County Coun-ty Court House in the City of Provo. in Utah County, Utah, sell at public auction to the highest and best biddpr for cash, said premises prem-ises and water rights hereinbefore described, together with all the right, tirle, benefit and equity of redemption of the said Charlee August Allen and blon L. Allen, their heirs and assigns therein forever for the purpose of paying said indebtedness and interest thereon, there-on, and the costs, attorney's fees and expenses of executing this trust, and will make, execute, exe-cute, acknowledge and deliver to the purchaser pur-chaser oor purchasers at said sale, good and sufficient deed or deeds of conveyance for tho premises sold.
