In his com plaint plaintiff alleges that he was and is co-owner with defendant oi the Eagle mine, and Blue Bell Mi nine claim, Tintic; that on June 21, 1890 Mr. Chrystal without the privilege if or consent of plaintiff obtained from the United States, patents to the whole of both mining claims and now refuses re-fuses to deed him an undivided one-half one-half or any part of them or either of them Donahue prays the court to require re-quire McChrystal to convev to him a one-half intereet in each otthe claims. Toe so it is brought by the bank against J, R. Hickman for $7,0S3.87, the astrepate oi ten checks alleged in the complaint, to have been drawn by Mr. Hickman and paid by the bank, interest and costs. For some time prior to July 6, 1893 (the date of the last of the ten checks sued on) Mr. Hickman, in partnership with Alma Hague was engaged in the business of buying and selling of sheep and cattle, cat-tle, Mr. Hickman, who is a nephew of Hagues, being principal of the firm. It is understood that it wa in the prosecution of the business of the iirm that the checks in quieBtion were drawn. In its complaint the bank alleges that in consideration of the payment by it of each and every check Mr. Hickman promised to repay the bank, that after pavment and prior to the commencement of this suit, alain-tiff alain-tiff demanded payment of the various amounts from the defendant, but that he has not repaid tiie same nor any part thereof. Mr. Hickman does not care to give his side. of... the case but intimates that after the case is tried the firm will be on his Bide. He claims to have made deposits in the bank aggregating more than the amount sued for, before he wrote the checks in question, and that he has evidences of the earns. From the fact that this suit is brought it would appear ap-pear that he never got credit on the bank books for the deposits he made, if he made them as he cla'ms to be able to prove he did, and there may be a cross complaint entered against the bank for more money than it is suing Hickman for. The present status of tne case is that the complaint has been filed by the bank and a demurrer to the complaint interposed by the defendant de-fendant on the gounds that the said complaint does not state facts sufficient to constitute a cause of action.
