The decision upholds the collector's col-lector's fees to the amount of $1 for each eale, and Validated tax sales io the city on account of the municipal tax levy, but maintains that the city and not the county must bid in the delinquent de-linquent property. The sensation of the opinion, however, is in the declaration decla-ration that there is no authority for any officer to collect the local school tax in cities of the first and second classes, (Provo is a city of the second class) and that in consequence euch taxes as are attempted to be levied and put on the assessment roll are void. Judge Smitn's opinion is lengthy and goes into much argument itive detail. His main grounds for declaring any school tax levied by cities of the first and second cl asses is void and cannot bi collected is that the law on this subject passed by the legislature makes the work of extending the assessment on the aFsesament roils the duty of the city assessor aid collector, and the same legislature on the same day it passed this law, abolished the office of city assessor and collector and alao abollehed the city assessment roll so that under the law there 19 no officer to do the work and no city roll on which to extend the assessment. Judge Smith holds that the county collector has legally nothing whatever to do with this work, and that the assessment cannot be legally extended on the county rolls.
