streets carried the committee on streets and allees submitted the following resolution WHEREAS a contract was made and entered into by and between provo city of the first part and utah asphaltum company of the second part on the adny of october A D 1890 by the terms of which eaid company was to lay asphaltum or bituminous rock sidewalk pavement upon certain streets in prove city and to furnish material and perform all work in connection with the same in a good and workmanlike manner and in accordance with certain plans and specifications in said contract contained and said utah asphaltum company haa not laid said pavement or any pavement in said city in pursuance of said contract or at all and has tailed to comply with each and every one of the agreements therein contained to be by it and performed and said company has been frequently requested by eaid city to carry out the contract to which requests no attention lias been paid now ba it n solved by council ot provo city that the recorder be and ha is hereby instructed to notify said utah As balum company that if said sidewalk pavement be cot laid a contract fully performed so far as its terms are applicable to it on or before the irth day of july A D i then said city will rescind cancel ana annal the same as far as it is within us power and will hold itself free from its aud terms passed june the resolution was passed on motion of mr glazier amended by mr maiben the recorder was in spruced to confer with the county court and request that the county relinquish its right to a diagonal street running from douglass Dou plass blacksmith shop northwest to milners Mil ners place carried mr glazier moved that tha committee on streets and allays he authorized to confer with the owners of land adjoining fourth estreet with a view to straightening straighten ine same carried mr dixon moved that the street supervisor he instructed to comply with the order of june 3 1890 in relation to bridging the ditches on seventh street between A and J streets excepting the factory rac the full width of the street in the B of mr liddiard the vote was a tie henrichsen dunn and dixon in the affirmative and maiben thomas and glazier in the negative tha mayor decided by voting with the negative giving as his reason the strained financial condition of the city council adjourned until thursday evening june
