Day of April, 2003, the ' Municipal Council of - Pleasant Grove City, i Utah (the "City") adopted a resolution ; declaring its intention to create a special improvement district to " be known as Pleasant 1 Grove City, Utah Special Spe-cial Improvement District Dis-trict No. 2003-1 (the "District"). It is the intention of the City to ' make improvements within the District and ' to levy assessments as ' provided in Chapter 3, C Title 17A, Utah Code ' Annotated (1953), as amended, on the real estate lying within the : District for the benefit of which such assessments assess-ments are to be expended in the making mak-ing of such improve-m improve-m e n t s . Purpose of District: To construct road improvements including includ-ing sidewalk, curb and gutter to make it safer for pedestrians and . students walking to and from elementary and Jr. high schools and to improve the storm drainage system in the area. Deescription of District: Dis-trict: The proposed District Dis-trict are the properties that have frontage on Center Street, 100 East to 700 East; 300 East Street from Center Street to 100 North; and 780 North from 600 East to Mahogany Drive (700 East) that do not have existing curb, gutter and sidewalk side-walk improvements. Intended Improvements: Improve-ments: The improvements to be constructed within with-in the District in general gener-al include the follow-i follow-i n g Required Improvements: Improve-ments: To excavate for and construct concrete . curb, gutter and side-' side-' walk, driveway approaches, handicap ramps at intersections, and driveway tie-ins, both sides of Center Street, 100 East to 700 East; 300 East Street from Center Street to 100 North; and 780 North from 600 East to Mahogany Drive (700 East) that do not already have said improvements, (there are other improvements, improve-ments, such as asphalt street paving, miscellaneous miscella-neous piping, etc., which are required to complete the project; however, the cost of said other improvements improve-ments are to be paid with other City funds.) The Pleasant Grove City Planning Commission Commis-sion will meet Thursday, Thurs-day, April 10, 2003, at 7 p.m. in the Community Commu-nity Development Conference Con-ference Room, 86 East 100 South (enter in the south door), Pleasant Grove, Utah. Work sessions ses-sions will be held from 5:30 to 7 p.m. and again after 10 p.m. Work sessions are public meetings; however, how-ever, no testimony will be heard and no official actions will betaken on items discussed. From 7 to 10 p.m., regular business items shown below will be addressed. Although the public is invited to attend all sessions, public comment is normally nor-mally accepted only during the regular business session. 5:30 p.m. Work Session Commission members mem-bers and stalf will dis Cms ant Special Improvement Dist. tioned improvements are those which are to be installed, as determined deter-mined by the City, and shall be completed if the District is formed. The District, may, if instructed by property owners, install optional improvements, such as concrete or asphalt driveways and assess such improvements to each individual property proper-ty owner. Estimated Cost of Improvements: The total cost of improvements (curb, gutter and sidewalk, drive approaches, etc.) in the proposed District, Dis-trict, as estimated by the City Engineer, is $88,600.00, to be paid by an assessment to be levied against the property prop-erty abutting upon the streets to be improved. The property owners' cost of the improvements improve-ments may be financed during the construction period by the use of interim warrants. The interest on said warrants war-rants will be assessed to the property owners. The estimated cost to be assessed against the benefitted property within District shall be as follows: Required Improvements: Improve-ments: Curb, gutter and sidewalk, estimated cost $24.50 per lineal foot Driveway approaches, approach-es, estimated cost $50.00 each Handicap ramps at intersections, estimated estimat-ed cost $2,500.00 each Driveway tie-ins, estimated cost $2.75 per sq. ft. Optional Improvements: Improve-ments: Concrete driveways: drive-ways: estimated cost $2.50 persq. ft. Asphalt driveways: estimated cost $2.00 per sq. ft. Lew of Assessment: It is the intention of the Council of the City to levy assessments as provided by the laws of the State of Utah on all parcels and lots of real properly within the District benefitted by said improvements. The purpose of the assessment and levy is to pay those costs of the subject improvements, improve-ments, which the City will not assume and pay. The method of assessment shall be apportioned according to the front footage of lots and parcels of property that have frontage on Center St., 300 East, and 780 North, unless otherwise other-wise specified. The assessments shall be levied according to the benefits to be derived by each property within the District. Other payment pay-ment provisions and enforcement remedies shall be in accordance with Chapter 3, of Title 17A, of Utah Code Annotated (1953), as amended. A map of the proposed pro-posed District and other related information informa-tion are on file in the office of the City Recorder, who will make such information available to all interested interest-ed persons. Time For Filing Protests: Any person who is the owner of record of property to be assessed in the District described above in this Notice of Intention shall have the right to file in writing a protest against the creation of the District or to make any other objections relating thereto. Protests shall describe or otherwise identify the property owner of record by the person or persons making the protest. Protests shall be filed with the City Recorder of Pleasant Grove City, Utah, on or before 4:30 p.m. on or before the 14th Day of May, 2003. Thereafter, the City Council will meet in public meeting on Tuesday, May 20, 2003, at 7 p.m. in the Community Development Develop-ment Conference Room (south entrance), 86 East 100 South, Pleasant Grove, Utah, to consider all protests so filed and hear all objections relating to the proposed pro-posed District. At such time, if 50 percent of the total assessable front footage of property prop-erty shall protest the formation of the District, Dis-trict, the District shall not be created.
