OF ARTICLE alii OF THE constitution OF THE STATE OF UTAH RELATING TO THE SUPREME AND DISTRICT COURTS HOW constituted TERMS OF OFFICE qualifications ALIFI OF JUDGES JUD jurisdiction J JUDGES PRO TEMI PORE CHANGE OP OF JUDICIAL DISTRICTS BY THE legislature SELECTION OF JUDICIARY AND EFFECT ON INCUMBENT JUDGES be it enacted by the legislature of the state of utah two thirds of all members elected to each of t the he two houses voting in faver thereof section 1 it is proposed to amend section 10 of article VII of the constitution of the state of utah as follows see sec 10 the governor shall nominate and by and with the consent of the senate appoint an all state and district officers whose offices are established by this constitution ution or which may be created by law and whose appointment or election is not otherwise provided for if during the recess of the senate e nai a vacancy occurs in any state t e or 0 district office the governor shall appoint so some me fit person to discharge the duties thereof until the next meeting of the senate when lie he shall nominate some person to fill such office it if the office of secretary of state state auditor state treasurer attorney general or superintendent of public instruction st be vacated by death resignation or otherwise it shall be the duty duly of the governor gov einor to fill the same by appointment and the appointee shall hold his office until his successor shall be elected and qualified as may bs be by law provided section 2 that it is proposed to amend sections 2 3 5 6 and 12 of article vill VIII of the constitution 0 of f the state of utah as follows sec 2 the supreme court shall consist of five judges which number may be increased or decreased by the legislature but no alteration or increase shall have the ef feet of removing a judge from of flee fice A majority of the judges constituting sti the court shall be necessary to form a quorum or render a decision if a just austice lu stice lee of the supreme court shall be disqualified from sitting in a cause ca use before said court the remaining judges shall call a district judge to sit with them on the hearing of such cause every ludge judge of the supreme court shall be at least thirty years of age an active member of the bar in good standing learned in the law and a resident of the state of utah for the five years next preceding his selection the judge having the shortest term to serve not holding ills his office by selection to till fill a vacancy before expiration pi of a regular term shall be the chief justice and shall preside at all terms of the supreme court and in case of his absence the judge having in like manner the next shortest term shall preside in his stead sec 3 judges of the supreme court and district courts shall be selected for such terms and in such manner as shall be provided by law provided however that selection shall be based solely upon consideration of illness fitness for office without regard to any partisan political considerations and free from influence of any person whomsoever e anc anc provided further that the method of electing such judges in effect when this amendment Is adopted shall be followed until changed by law sec 5 the state shall be divided dmd into seven judicial districts tor for each of which at least one judge shall be selected teC as hereinbefore provided until otherwise provided by law cwi a district court at the county I 1 seat of each county shall bs be held at least tour four times byear a year all ali civil and criminal business arising in any county must be tried in such county unless a change of venue be taken in such cases as may be provided by law constitutional no M 2 0 AMENDMENT A JOINT resolution PROPOSING TO AMEND SECTION 9 ARTICLE VI OF THE C constitution OF UTAH RELATING TO compensation OF MEMBERS OF THE legislature be it resolved by the legislature of the state of utah two thirds of all members elected to each of the two houses voting voting I 1 favor thereof section 1 that bat it is proposed to amend section 9 article vl VI constitution of the state of utah to read section 9 the members of the legislature shall receive such compensation pensa tion and mileage as the legislature may provide not exceeding 00 per year end and ten cents per mile for the distance necessarily traveled tr aled going to and returning from the place of meeting on the most usual route and they shall receive no other pay or perquisite section 2 the secretary secie tary of tate state a Is hereby directed to submit this proposed amendment to the electors of the state ot of utah at the next general election in the manner as provided for by article 23 section 1 constitution of utah section 3 if adopted by the electors
