It is proposed to amend Article VII of the Constitution of the State of Utah by adding a new section thereto designated, Section 24, to read: Notwithstanding any general or special provisions or the Constitution the legislature, in order to insure continuity of state and local governmental operations in periods of emergency resulting from disasters caused by enemy attack, shall have the power and the immediate duty (1) to provide for prompt and temporary succession to the powers and duties of public offices, of whatever nature and whether filled by election or appointment, the incumbents of which may become unavailable for carrying on the powers and duties of such offices, and (2) two-thir- ed to each of Section 2. The Secretary of State is directed to submit this proposed amendment to the electors of the State of Utah at the next General Election In the manner provided by law. Section 3. The Nebo SCD boundary signs at the south and north boundaries of the District are to be moved off the Utah State Highway right of way at the request of the Road Commission. Tom Spotten of Genola and Lloyd Penrod of Goshen, both supervisors of the District moved the south one a few days ago. Snell Olsen and Bernell Hansen, Supervisors from Spanish Fork will move the north one, and reestablish them on private ground as near the boundary lines as possible. Jim West and Sterling Jones have each installed a short section of lined ditch n their farms in the District. Henry Mitarai is planning the installation of about 1000 feet on his Elberta farm. Interest in the lining of irrigation ditches is growing very fast, and about 15 ditches are planned for installation at the Dresent time for this fall. Measurements of water by the South Fields Irrigation Company of Spanish Fork indicates that losses are pretty high in he Company ditches. The losses varied from 1 cubic foot per second to about 2.5 cfc in a mile of canal. As a result of these losses and thru the hard work of the Board of Directors under President Lawrence Johnson, about 12 miles of canal is planned for lining in the next two years. The SCS, SCD are serving as he technical force for the nroject. The Agricultural Conservation Program is aiding in the financial backing along with the Utah Water and Power Boarji. It should be a most beneficial project. Two miles of canal will be installed this fall by the East Warm Spring Irrigation Co. of Genola. CONSTITUTIONAL AMENDMENT A JOINT RESOLUTION PROPOSING TO AMEND ARTICLE XIII, SECTION 2 OF THE CONSTITUTION OF THE STATE OF UTAH, RELATING TO TANGIBLE PROPERTIES EXEMPT FROM TAXATION. Be it resolved by the Legislature of the State of Utah, of all members elected to each of the two houses voting in favor thereof: Section 1. It is proposed to amend Article XIII, Section 2 of the constitution of the State of Utah to read as follows: All tangible property in the state, not exempt under the laws of the United States, the State of Utah, or under this constitution, shall be taxed in proportion to its value, to be ascertained as provided by law. The property of the state, counties. cities, towns, school districts, municipal corporations and public libraries, lots with the buildings thereon used exclusively for either religious worship or charitable purposes, and places of burial not held or used for private or corporate benefit, shall be exempt from taxation. Water rights, ditches, canals, reservoirs, power plants, plants, transmission lines, pipes and flumes owned and used by individuals or corporations for irrigating lands within the state owned by such individuals or corporations, or the individual members thereof, shall not be separately taxed as long as they shall be owned and used exclusively for such purposes. Power plants, power transmission lines and other property used for generating delivering electrical power, a portion of which is used for furnishing power for pumping water for irrigation purposes on lands in the State of Utah, may be exempted from taxation to the extent that such property is used for such purposes. These exemntions shall accrue to the benefit of the users of water so pumped under such regulations as the legislature may prescribe. The taxes of the indigent poor may be remitted or abated at such times and in such manner as may he provided by law. The legislature may provide for the exemption from taxation of homes, homesteads, two-thir- and personal property, not to exceed $2,000 in value for homes and homesteads, and all household furnishings, furniture, and equipment used exclusively bv the owner thereof at his place of abode in maintaining a home for himself and family. Property not to exceed $3,000 in value, owned by disabled persons who served in any war in the military service of the United States or of the State of Utah and by the unmarried widows and minor orphans of such disabled persons or of persons who while serving in the military service of the United States or the State of Utah were killed in action or died as a result of such service may be exempted as the legislature may provide. The legislature shall provide by law for an annual tax sufficient, with other sources of revenue, to defray the estimated ordinary expenses of the State for each fiscal year. For the purpose of paying the state debt, if any there be, the legislature shall provide for levying a tax annually, sufficient to pay the annual interest and to pay the principal of such debt, within twenty years from the final passage of the law creating the debt. Section 2. The secretary of state is directed to submit this proposed amendment to the electors of the State of Utah in the next general election in the manner provided by law. Section 3. If adopted by the electors of this state, this amendment shall take effect the first day of January, 1961. I, LAMONT F.
