The matter is not as simple as it appears on the surface. It covers more than the mere signing of a waiver of 45 per cent of the Associations funds in the closed State Bank. There are a number of other items that are woven into the whole affair. file a preferred claim. On July 13, 1932, the board authorized the filing of a preferred claim with the State Banking Department. There was July 18, one dissenting vote. On at only 1932, of the stockholders of the Association, it was voted, in effect, to find out, by refering the matter to the Bank Commissioner, the amount of preferred money and the amount of common claim represented in the $23,000.00, and to waive 45 ver cent of the common claim. After this meeting the President made a special trip to Salt Lake City to put the desires of the Association before the Bank Commissioner. He was out of the city. Nevertheless, he was later reached by telephone and the request made of him. He declined a reconsideration at the question on the ground that no matter what the evidence might be, he could deside only one way, and referred the Association to the courts as the lawful and final means of determining the a meeting The M.
