Show NOVEMBER UTAH, 26, 1953 UTAH, NOVEMBER 19, 1953 March 28, 1949, (hereinafter called the "1949 Ordinance) authorised the issuance of Municipal Electric Light and Power Revenue Bondi, Series April 1, 1949, in the principal amount of $110,000, $94,uu0 of which bonds are now outs'anding and unpaid, and AN ORDINANCE AUTHORIZING THE ISSUANCE OK ELECTRIC WHEREAS, an Ordinance of said City adopted and approved on LIGHT AND AND POWER REVENUE REFUNDING AND 1M March 28, 1951, authorised the issuance of City of Parowan Electric PROVEMENT BONDS OF THE CITY OF PAROWAN, UTAH. IN and Power Improvement Revenue Bondi, Series April 1, 1951, THE AMOUNT t)F 250,000 FOR THE PURPOSE OF REFUNDING Light In the principal amount of (42.000 of which $39,ooo of said bonds are ELECTRIC LIGHT AND POWER IMPROVEMENT REVENUE outstanding and unpaid; and BONDS, SERIES APRIL 1. 1951, AND IMPROVING AND EXTEND WHEREAS, it is propoied to refund said $39,000 of Bonds, Scries ING THE ELECTRIC L1CHT AND POWER SYSTEM OF SAID CITY April 1, 1951, with part of the proceeds of the bonds authorized by PROVIDING FOR THE PAYMENT OF THE BONDS AUTHORIZED this Ordinance; and 1Y THIS ORDINANCE, AND THE INTEREST ON SUCH BONDS .WHEREAS, it is proposed to improve and extend the System by PRESCRIBING THE FORM OF SAID BONDS AND THE COLTON'S constructing hydroelectric generating plant on Red Creek, with TO BE ATTACHED THERETO. HE IT ORDAINED BY HIE H1Y COUNCIL OK I HE CITY OF PAROWAN IRON COUNTY, UTAH Section 1. That all proceedings heretofore taken and adopted for the construction of the proposed generating system, including the report by said Thomas C. Adams, be and the same are hereby ratified, approved and confirmed. Section 2. That a brief description of the proposed improvements is the construction and installation of a hyro electric power plant on Red Creek, together with incidental equipment and appurtenances, in order to connect such hydroelectric generating plant with the existing electric light and power system of the City, Section 3. The estimated cost of the proposed improvements is 1185,000, and it is not anticipated that bonds for that purpose will be issued m excess of such amount But in order to provide for possible increases in the cost of labor and materials, it has been deemed advisable to authorize $26,000 of additional bonds to be S!,ued only if necessary Section 4 That for the purpo.ie of protecting the public health, conierving the projicrty and advancing the general welfare of the City of larowan and the inhabitants thereof, and in order to provide funds for the payment of $39,000 of said Series April 1, 1951 Bonds, and for the purpose of providing the costs and expenses of constructing and installing said hydro electric generating plant, bonds of the City of Parowan, each to be known as "Electric Light and 1ower Revenue Refunding and Improvement Bond, Series 1953" shall be issued in the principal amount of $250,000, which bonds and the interest thereon shall be payable solely out of a fixed proportion of the net revenues to be derived from the alteration of the Syteru, and not otherwise, as hereinafter provided. Section 5. Said bonds shall be dated as of December 1, 1953, and shall consist of 250 bonds in the denomination of $1,000 each, numbered 1 to 250, inclusive, shall bear interest at the rate or rates to be determined at the time they are sold, but not to exceed per centum per annum, payable semi annually, and they shall mature on December 1, $14,000 in each of the years 1956 to 1972, inclusive, and $12,000 in 1973. Bonds maturing in the years 1964 and thereafter shall be redeemable at the option of the City on December 1, 1963, and on interest payment dates thereafter, in inverse numerical order, at par, accrued interest ami a premium equivalent to one years interest comuted at the inteiest rate borne by the bond in the year immediately following the dale of redemption. Notice of redemption shall be published in a newspaper of general circulation in the City thirty days prior to the date of call, and at such time a copy of the Notice shall be sent to F. T. Boise & Company, 25 East Second South, Salt Lake City, Utah, and to the original purchaser of the bonds. Section 6. Said bonds shall be fully negotiable, and shall have all the qualities of negotiable paper, and the holder or holders thereof shall possess all the rights enjoyed by the holders of negotiable instruments under the prov isions of the Negotiable Instruments Law. Section 7. The principal of and interest on said bonds shall be payable at the Continental Bank A Trust Company, Salt Lake City, Utah, in lawful money of the United States of America, without deduction for exchange, or collection charges.
