SUMMIT COUNTY ORDINANCE NO. 267 AN ORDINANCE APPROVING AND ADOPTING THE CONSENT AGREEMENT FOR THE EAGLE RIDGE PROJECT Preamble WHEREAS, the owners and developers of the Eagle Ridge Development have applied for specific plan development approval for the Eagle Ridge project under 6.4 of the Summit County Administrative Regulation, Ordinance No. 202 and 14.1, et seq., of the Snyderville Basin Development Code Administrative Guidelines, Resolution No. 93-1; a- n d t WHEREAS, Summit County, acting pursuant to its authority under Utah Code Ann. 17-27-101 et seq., has made c , e r t a I n determinations with respect to the proposed project and, in the exercise of its legislative discretion, has elected to process the project pursuant to 6.4 of the Administrative Regulations, and 14.1, et seq. of the Administrative Guidelines, resulting in the negotiation, consideration and approval of this Consent Agreement after all necessary public hearings; and, WHEREAS, the Board of Commissioners of Summit County unanimously passed a motion on July 10, 1995, following the completion of. the necessary public hearings, tentatively granting specific plan development approval for the Eagle Ridge project and tentatively approving this Consent Agreement; a n d WHEREAS, It Is in the best interests of Summit County and health, safety and general welfare of its citizens to adopt this ordinance in order to resolve certain disputes between the parties with respect to the design and density of the project and to address other issues and policies as reflected in the Consent Agreement; NOW, THEREFORE, the County Legislative Body of the County of Summit, the State of Utah, ordains as follows: Section 1.
