LEGAL NOTICE :,: RESOLUTION NUMBER 11 ; A RESOLUTION PROVIDING "' FOR THE HOLDING OF A SPECIAL ELECTION IN OREM CITY, UTAH, FOR THE PUR-POSE PUR-POSE OF SUBMITTING TO THE QUALIFIED TAXPAYING ELECTORS THEREOF THE QUESTION OF THE ISSUANCE OF $716,000 GENERAL OBLIGATION OB-LIGATION BUILDING BONDS OF SAID CITY. WHEREAS it is necessary for Orem City to construct and ac- quire a city center to consist of a public building to house ad- x ministrative offices, a council room, city court facilities, city police department, a library and other related city functions, in-- in-- eluding all necessary appurtenant equipment and furnishings there- for, for said city; and WHEREAS Orem City does not have on hand sufficient funds for " the payment of the cost of said construction and acquisition and, subject to the approval of the qualified property taxpaying voters, vot-ers, desires to issue the bonds hereinafter more specifically described de-scribed to pay such cost; NOW, THEREFORE, Be It and It Is Hereby Resolved by the City Council of Orem City, Utah County, Utah, as follows: Section 1. That on the 20th day of February, 1968, there shall be uciu iu uicui iujr a scviai election elec-tion between the hours of 7:00 o'clock A.M. and 8:00 o'clock P.M.: at which there shall be submitted to such qualified electors elec-tors of said city as shall have paid a property tax therein within twelve months before such election elec-tion the proposition appearing in the form of ballot set out in Section 4 hereof. Section 2. That the voting places for said election and the election judges and the alternate election judges to serve at each voting place, each of whom Is a qualified qual-ified elector of the city, shall be those specified in the form of notice of election set out in Section 3 hereof. Section 3. Hendrix, Alternate The voting at such election shall be by ballot, which ballots will be furnished by the City Recorder Re-corder of Orem City to the judges of election, to be by them furnished furnish-ed to the qualified voters. The polls at each polling place will be open from 7:00 o'clock A.M. to 8:00 o'clock P.M. There is to be no special registration reg-istration of voters for such election elec-tion and the official register last made or revised shall constitute the register for such election, except that the County Clerk of Utah County will register at his office during regular office hours, except Saturdays, Sundays and holidays, and except during the ten-day period immediately preceding pre-ceding the bond election, any person who on the day of the election elec-tion will be a qualified elector and will register such person as provided by law. The County Clerk will make available or will cause the registration agents to make available at each of the above described polling places, a registration list or copy thereof listing all registered electors entitled en-titled to use such voting place. Only such qualified electors of Orem City as shall have paid a property tax therein within twelve months preceding such election will be permitted to cast a ballot at such election. Electors are further advised .that they may establish that they paid a property tax on property situated within Orem City during the period of twelve months immediately im-mediately preceding the date of such bond election, by exhibiting a receipt of the County Treasurer of Utah County (which receipt may be in the form of a tax notice appropriately stamped by the County Treasurer to show payment pay-ment thereof) reflecting that such person has paid within twelve months before said election (after February 20, 1967) a tax upon property located in Orem City and title to which is held in his name according to the assessment assess-ment roll of Utah County, if the elector has such a tax receipt available for presentation; PROVIDED, PRO-VIDED, HOWEVER, THAT ANY QUALIFIED ELECTOR OF OREM CITY SO OFFERING TO VOTE WHO LACKS SUCH TAX RECEIPT SHALL NEVERTHELESS BE PERMITTED TO VOTE AT SAID ELECTION IF HE SHALL TAKE AN OATH, WITH OR WITHOUT CHALLENGE, UNDER PENALTY PENAL-TY OF PERJURY, TO THE EFFECT EF-FECT THAT HE HAS PAID WITHIN WITH-IN TWELVE MONTHS PRECEDING PRECED-ING SAID ELECTION A TAX ON PROPERTY LOCATED IN SAID DISTRICT AND TITLE TO WHICH IS HELD IN HIS NAME ACCORDING ACCORD-ING TO THE ASSESSMENT ROLL OF THE COUNTY. That the necessary ballot boxes, paraphernalia, equipment, supplies and ballots to be used in voting upon the proposition submitted shall be prepared and furnished by the City Recorder to the boards of election to be furnished by them to the voters. Every person applying for a ballot at any polling place designated for the conduct of such election before being permitted to vote shall be requested by the election officials to exhibit a receipt of the County Treasurer of Utah County reflecting that such person has paid, within twelve months before said election elec-tion (after February 20, 1967) a tax on property located in said Orem City and title to which is held in his name according to the assessment roll of the county; provided however, that any person applying for a ballot at any polling poll-ing place designated for the conduct con-duct of such election who lacks such tax receipt shall be permitted permit-ted to vote if he shall take an oath, with or without challenge, under penalty of perjury, to the effect that he has paid within twelve months preceding said election a tax on property located lo-cated in Orem City and title to which is held in his name according accord-ing to the assessment roll of the county, in the form in which such oath is set out inSection 7 hereof. Section 6. That any person applying ap-plying for a ballot at any polling place designated for the conduct of such election, whose qualifications qualifica-tions to vote are challenged for cause by any one or more of the election officials or by any other person at the time the ballot is applied ap-plied for shall receive a ballot and be permitted to vote if (1) such person is shown on the registration registra-tion lists as a registered voter in Orem City and (2) such person takes an oath in the form in which such oath is set forth in Section 7 hereof, sworn to before one of the election officials that he is a qualified elector of Orem City and owns any property therein, there-in, title to which is in his name, and has paid a property tax thereon there-on within twelve months preceding pre-ceding such election. In the case of any such challenge chal-lenge or challenges, the election judges shall keep a list of the names of each person challenged, the grounds for such challenge and whether or not such person was permitted to vote. Such lists shall be made in duplicate by the election judges at each polling place and after the polls shall have been closed a duplicate list shall be returned to the City Council Coun-cil by the election judges, so that such duplicate list will be available avail-able to the City Council when it canvasses the election results. Section 7. That the oath referred refer-red to in Sections 5 and 6 hereof shall be in substantially the following fol-lowing form: - ' ELECTOR'S OATH STATE OF UTAH ) ) COUNTY OF UTAH ) The undersiped, having been first duly sworn upon oath deposes de-poses and says under the pains and penalties of perjury, as follows: fol-lows: That I am a citizen of the United States and have been so for not less than ninety (90) days; that I am of lawful voting age; that I am now and have been a resident resi-dent of the State of Utah for not less than one (1) year, of Utah County for not less than four (4) months, and of the voting district of the municipal ward of Orem City in which I am offering to vote for not less than sixty (60) days; that I am a duly registered voter of Utah County, and I am a qualified voter of and reside within the confines of Orem-City; that I own property located in Orem City, title to which is held in my name, and that I paid a property tax thereon during the twelve months preceding this election; and that I have not previously voted at the bond election elec-tion being held on this 20th day of February, 1968, in Orem City. Judge of Election Each of the election officials specified in the form of Notice of Election set out in Section 3 hereof is expressly authorized to administer such oath in accordance accord-ance with the provisions of Section Sec-tion 6 of Chapter 14 of Title 11, Utah Code Annotated, 1953, as amended. Section 8. That immediately after the polls are closed the judges appointed to conduct the election shall proceed to count and canvass the votes, and shall promptly thereafter certify the result to the City Council, and the said City Council shall meet as a Board of Canvassers within ten (10) days after the date of said election, to wit: On Monday, the 26th day of February, 1968, at the hour of 8:00 o'clock p.m. at its regular meeting place in the City Hall in Orem City, Utah, and if the majority of the .votes cast at such election are in favor of such proposition submitted, then the City Council shall cause an entry of that fact to be made upon its minutes, and thereupon this City Council shall be authorized author-ized and directed to issue such bonds. . Section 9. That immediately after its adoption this resolution shall be signed by the Mayor and City Recorder, shall be recorded re-corded in a book kept for that purpose and shall take immediate effect. Important issues are being discussed that will influence our city's interests for years to come. There are aches and pains in updating up-dating any civic projects due to selfish interests, groups of con-servatists con-servatists who think things are satisfactory for the present and willing to place the needed improvements im-provements on future generations, Orem City has made mistakes but with history as a teacher, we can make less errors by proper planning and developing a cooperative spirit among all people within the city limits. Thus answers to these few questions listed will help us as citizens of Orem to vote intelligently that our city fathers present. Let's ponder the questions herein listed: 1. Would the City administrators administra-tors list the five top projects they think most essential in order of importance and possible costs of each? 2. How could each be financed? 3. They have listed the civic center, prepared the cost, manner man-ner of financing it, and area selected. May we present these questions concerning the civic center and other civic interests: 4. Isn't the $75,000 offered by the power company a small sum to be 475 M bd. ft. of ponderosa pine appraised at $6.55 per M bd. ft., 125 M bd. ft. of Douglas fir, appraised at $9.65 per M bd. ft., 49 M bd. ft. of Engleman spruce appraised at $4.05 per M bd. ft., and 1 m bd. ft of white fir appraised at $3.85 per M bd. ft. Don't those who offer this franchise know if it is worth $75,000 now, that in 25 years it could and will be worth three times that amount in taxes due to new power needs the next two decades? . 6. Isn't it possible the two plants the Utah Power and Light Company now operate at the m-il! ! ?rovo Canyon will become obsolete and will remove them and build another elsewhere? 7. If so, would they pay more taxes if they built another according accord-ing to its assessed valuation tc the City of Orem? 8. If they (Utah Power) purchased pur-chased cheaper power from other power units or projects, could we expect lower power rates within the city? 9. Would it be feasible and profitable to seek competitive bids for this franchise from other power interests who care to furnish electric power to a growing grow-ing city as Orem? 10. Isn't it a poor risk to us to sell a 50 year power franchise for a flat rate of$ 75,000 annually instead of increased annual premium pre-mium every decade based on amount of power used and on a profit basis? 11. Are we sure the present civic center area is sufficiently large enough to care for a city to be of 50,000 people by 1990? Lets take a few lessons from the mistakes made by neighboring cities before it is too late. Qf Qreill Men Succumbs Services in Fairview were held Monday for Selma Jensen Anderson, Ander-son, 72, Fairview, mother cf two Orem men, who died Thursday at the Gunnison Hospital of a heart attack following a seven-week illness. She was born Oct. 15, 1895, at Ephraim, the daughter of Ole Christian and Elsie Marie Mor-tensen Mor-tensen Jensen. She married James Cleon Anderson on Dec. 22, 1915,' in the Salt Lake LDS Temple. Survivors Include her husband of Fairview; eight sons and four (daughters; Blake J. Anderson, Sherrill E. Anderson andGaryD. Anderson, all of Fairview; Doyle M. Anderson, Salt Lake City; J. Allen Anderson and Ernel L.Anderson, L.An-derson, both of Orem; Lowell R. Anderson, Boise, Ida.; Oren C. Anderson, now serving in the ;Armed Forces; Mrs. DaRue Burn-side, Burn-side, Mt. Jess Cooper Spends Three Weeks In Utah Hospital Jess Cooper is reported recuperating re-cuperating at home following a three-week stay in Utah Valley Hospital after he suffered a heart attack.
