LEGAL NOTICE ORDINANCE 91 AN ORDINANCE PROVIDING FOR THE LICENSING AND REGULATION OF PUBLIC DANCES, AND PROVIDING PENALTIES FOR THE VIOLATION VIO-LATION THEREOF, AND REPEALING RE-PEALING ANY AND ALL ORDINANCES ORD-INANCES OS PARTS OF ORDINANCES ORD-INANCES IN CONFLICT THEREWITH, AND DECLARING DECLAR-ING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF OREM CITY: SECTION 1: The term "public dance" as used In this ordinance shall be taken to mean any dance to which admission can be had by paying a fee or by the purchase, possession, or presentation of a ticket or token in which a charge is made for caring for clothing or other property, or the payment of a fee for music from a music record vending machine or music from any number num-ber of musicians personally present pre-sent and playing in the presence of those in attendance. SECTION 2: It shall be unlawful unlaw-ful for any person whether as principle or agent, clerk or employee, em-ployee, either for himself or for any other person, or for any body corporate, or as an officer of any corporation or otherwise to commence com-mence or carry on, to hold or conduct any public dance in any hall or building within the limits of Orem City until such public dance shall have been first duly licensed. SECTION 3: An applicant for a public dance license shall make application to Orem City for such a license and the same shall be accompanied by a cashiers check in the amount of the license fee called for by the Orem City ordinances, ord-inances, and the application shall be upon a form furnished by the City, signed under oath by the applicant, and addressed to the Orem City Recorder. The form shall require information showing show-ing the location of the dance premises, applicant's age, citizenship, citi-zenship, moral character - and reputation, and conviction of a felony or misdemeanor involving moral turpitude, if any. If applicant ap-plicant be a partnership or association as-sociation of a corporation or association member or corporate director or corporate officer. Each licensee must be over the age of twenty-one years, of good moral character and a citizen ot the United States. No license shall be granted to any applicant who has been convicted of a felony or misdemeanor involving moral turpitude. If applicant be a partnership, part-nership, association or corporation, corpor-ation, each partner, association or a corporation, each partner, association member, or corporate corpor-ate director or corporate officer shall meet all of the foregoing qualifications. SECTION 4: The Police Department De-partment shall examine all applications appli-cations and investigate all applicants appli-cants for licenses under this ordinance, or-dinance, and shall examine the premises wherein the public dance is to be conducted to determine de-termine whether or not the place for which the license is issued complies with and conforms to all laws, ordinances and health regulations regu-lations applicable thereto, and Is properly ventilated and supplied with separate and sufficient toilet conveniences for each sex, and is properly lighted, and that there is adequate facilities for off street parking, and is a safe and proper place for the purpose for which it shall be used. Following such examination and investigation, the recommendations of the Police Department shall be made In writing writ-ing to the Orem City Manager, and he shall refer the same to the Orem City Council for its approval and issuance by the Council. The Fire Department shall examine ex-amine the premises wherein the public dance is to be conducted to determine whether or not the place for which the license is Issued complies with and con forms with the fire regulations of Orem City applicable thereto. The Police Department shall be permitted to have access to all premises licensed or applying for licenses under this Ordinance, shall make periodic Inspections of said premises and report its findings to the Orem City Manager. Mana-ger. Any license issued pursuant to the findings under the provisions of this ordinance, may after a hearing, be suspended, or revoked for the violation by the licensed premises of any provisions of this or any other applicable ordinance or-dinance or law, or if it be determined de-termined that the licensee is no longer a fit person to hold said license under the standards herein here-in set forth. The Orem City Council shall hear and determine all suspension and revocation matters. No such license shall be revoked until a hearing shall have been held by the Orem City Council. Written notice of such hearing shall be served at least 10 days prior to the date thereof upon the holder of such license or his or its manage or agent. Such notice shall statji the ground of complaint against the holder of such license, and the time when and place where such hearing shall be had, and it shall be served by delivering the same personally to the holder of such license, or to his or its manager or agent. SECTION 5: Each license issued is-sued pursuant to this ordinance shall not be transferable and shall be at all times displayed on the licensed premises in a place readily visible to the public. SECTION 6: It shall be unlawful for any person holding a license for a public dance to permit customers, guests, or any other person to posess liquor, beer, or alcoholic beverages of any kind or nature, or to consume liquor, beer, or alcoholic beverages of any kind or nature on the licensed premises. SECTION 7: It shall be unlawful for any person maintaining or conducting any such dance hall to allow or permit any intoxicated, boisterous or disorderly person to enter, be. or remain In, or by-Uance in such hall, nor shall any smoking be indulged in, or be permitted to be indulged in, in any place where a public dance is being held. SECTION 8: It shall be unlawful for any person to whom a dance hall license is issued, or for any person conducting a public dance hall or public dance under permit from Orem City, to allow or per mit in any dance hall any Indecent In-decent act to be committed, or any disorder or conduct of a gross violent, or vulgar character. Any member of the police or other properly constituted authority shall have the power, and it shall be the duty of each of them, to cause any dance hall to be vacated whenever any provision of this ordinance, or any regulation, regu-lation, or law concerning dance halls has been or is being violated, vio-lated, or wherein any ordinance, regulation, or law of any character charac-ter shall be violated, or where-ever where-ever any indecent act shall be committed or when any disorder -or conduct of a gross, violent. or vulgar character shall take place therein. SECTION 9: No pass-out or return checks shall be issued at any public dance. Any person leaving the dance hall shall be required to pay the regular admission ad-mission fee upon being readmit ted to such public dance hall, SECTION 10: The entire li censed premises including any booth, blinds, stall, or seating area shall be kept properly Illuminated Il-luminated at all times while oc cupied or open for business, and no booth, blinds, stalls or seating area shall be maintained unless all tables, chairs, and occupants, if any therein are kept open to the full view from the main floor at the entrance of such licensed prsmlsGS SECTION 11: It shall be unlaw. ful for any person conducting or maintaining any public dance hall or any person to dance, or to allowdanclng therein between the hours of 1 o'clock a.m. on any week day except Sunday and 8 o'clock a.m. on the same day, or between the hours of 1:59 p.m. on Saturday and 8 o'clock a.m. of the following Monday, except premises licensed by this ordin ance may be permitted to continue to 2 o'clock a.m. on New Years day. SECTION, 12: Between the hours of 10 o'clock p.m. and 4 o'clock a.m. of the following day of any day of the week other than Friday or Saturday and between the hours of 11 o'clock a.m. and 4 o'clock a.m, of the following day on Friday Fri-day or Saturday of any given week it shall be unlawful for any person conducting or maintaining any dance hall to permit any minor under the age of 16 to enter, be, or remain in such public dance hall or to dance therein at any time while the dance is in progress pro-gress or being conducted therein in Orem City or for said minor under the age of 16 to enter, be, or remain in such public dance hall or to dance therein at any time while the dance is in progress pro-gress or being conducted therein there-in in Orem City except where said minor is accompanied by an adult having the care and custody cus-tody of such minor and except in connection with high school functions where the minor is a i member of the high school soph omore class which is invited by the high school administrator to participate in a high school function. func-tion. SECTION 14: All ordinances or parts of ordinance in conflict con-flict with this ordinance are hereby here-by repealed. SECTION 15: Violation of any of the provisions of this ordinance ordin-ance shall constitute a misdemeanor misde-meanor and shall be punished by a fine in a sum not to ex ceed $299 or by imprisonment for not more than 30 days, or by both such fine and imprisonment. imprison-ment. SECTION 16: If any part of this ordinance shall be held invalid, in-valid, such decison shall not affect the validity of the remainder remain-der of this ordinance. SECTION 17: In the opinion of the City Council or Orem City, it is necessary for the preservation preser-vation of the peace, welfare, health, and safety of the inhabitants in-habitants of Orem City that this ordinance shall take effect immediately im-mediately upon its passage and publication for the reason that an emergency exists in that enforcement en-forcement of police powers is dependent upon the enactment of this ordinance which is Intended Intend-ed to safeguard the health and welfare wel-fare of the inhabitants of Orem City.
