It Is hereby expressly ex-pressly agreed and covenanted that Orem-City will not hereafter here-after issue any bonds or oblig ations payable from the revenues reven-ues of the system, or any part thereof, until all bonds herein authorized have been paid in full, unless such additional bonds are issued in such manner that they are in all respects subordinate to the bonds herein authorized. The provisions of the foregoing forego-ing paragranh are subject to the following exceptions: 1. If at any time alter me bonds herein authorized, or any part thereof, shall have been issued, the City Council shall find it desirable to refund said bonds, or any part thereof, may be rof'inded (but only with the consent of the holders thereof unless the bonds have matured or are then callable for redemption redemp-tion and have been properly so called) and the refunding bonds fo irsued shall enjoy complete equality of lien with the portion of said bonds which is noi refunded, re-funded, if any there be, and the holders of the refunding bonds shall be subrogated to all of the rights and privileges enjoyed by the holders of the bonds refunded ref-unded thereby. The refunding bonds shall be issued with rfuch details as the City Council may by resolution provide, provided only that if only a part of the outstanding bonds is refunded the interest rate of the refunded bonds may not be increased, no refunding bond may mature at a date earlier than the maurity date of any of the bonds not refunded, and the refunding bonds shall either be delivered in exchange for the boiw refunded, re-funded, or shall be delivered to the original purchaser ot those bonds at par and accrued Inter est and the proceeds thereof shall be, used to pay the bonds re funded. 2. The city agrees to furnish a copy of each such audit to the holder of any of the bonds at his request after the close of each fiscal year, and that any such holder shall have the right to discuss with the accountant making the audit aud-it the contents of the audit and to ask for such additional information infor-mation as he may reasonably require. d.
