(d) In general, the entire city for uses not listed above, off-street parking shall be provided pro-vided by any private owner or public agency in sufficient quantity quan-tity as determined by the Board of Adjustment to care for tne automobiles temporarily or per manently parked at the location as a result of the development. (6) No commercial billboards, electric display or advertising sign shall be permitted in any residential district. Section 2. Yards. (1) Front Yards. On one side of any street be tween two intersecting streets where twenty-five (25) percent or more of the frontage is im proved, the set-back, except for buildings on corner lots, may be the same as the average for the buildings along the street, pro vided that in no case shall the minimum set-back be less than twenty (20) feet. (2) Yard Duplication. No yard or other open space provided about any building for the purpose of complying with the provisions of these reg ulations shall be used as a yard or open space for another build ing. Section 3. Building Permits Already Granted. Nothing in this ordinance shall require any change in the construction or designated use of any building or structure for which a building permit has been legally granted before the enactment of this ordinance, and the construction of which building shall have been started within ninety (90) days of such enactment; except that if such building operation is discontin ued for a period of six (6) months, any further construction construc-tion shall be in conformity with the provisions of this ordinance Section 4, Areas Annexed to the City. New areas annexed to the city shall be zoned by the City Council after recommendation by the Zoning Commission and public hearing. Section 5. Notice. Whenever notice is required by this act to be given to the public, such notice shall be given giv-en by at least one publication in a newspaper of general circulation cir-culation within the city, printed at least fifteen (15) days prior to the time when such proposed ordinance will be considered by the City Council. Section 6. Non - Conforming Use. Any lawful use of buildings or land at the time of the pas-ace pas-ace of this ordinance that does not conform to the regulations prescribed in this ordinance shall be deemed a non-conform ing use- Such use may be continued con-tinued subject to regulations of the Board of Adjustment as provided in Article II S.ection 7- If such non conforming use is discontinued for a period of two years or more any future fu-ture use of said land must be in conformity with the provisions provis-ions of this ordinance. A nonconforming non-conforming use shall not be changed unless changed to a more restrictive use. A nonconforming non-conforming use if changed to a conforming use may not there after be changed back to any non-conforming use. No non conforming building which has been damaged by . fire explos ion, act of God, or act of the' public enemy to the extent of more than sixty (60) per -cent Of Its assessed value shall be restored re-stored except in conformity with the regulations of this or dinance. Section 7. Validity. If any part of this ordinance shall be held invalid, such decision de-cision shall not affect the vn. lidity of the remainder of the ordinance. Section 8. Penalty. Violation of any of the pro visions of this act shall upon conviction be nunishable as a misdemeanor- Each day that a violation is permitted to or 1st shall constitute a separate offense. Section 9. All ordinances, or parts of ordinances, in conflict here with, are hereby repealed. Section 10. It being deemed by the City Council of Orem City, that an emergency exists and that it is in the interest of the peace. health, safety and welfare of Orem City, and the inhabitants of "Orem City, that this ordin ance shall take effect Immedi ately upon its passage and publication; pub-lication; such emergency exists by reason of the rapid growth of Orem City; and the large in flux of people Into Orem City: that tVre is a !arge in crease vt h. jics nd bust nesses; that applications for building permits have greatly increased; in-creased; that there Is a considerable consider-able number of applications for building permits now to be passed pass-ed upon; that it is probable that there will be a large increase in-crease of building of homes and businesses and that Industrial plants will be erected, and in order to have such buildings and improvements erected under un-der an orderly and general plan and in order to meet the Immediate Imme-diate need it is necessary, for the immediate passage of this ordinance. NOW THEREFORE, it is hereby ordained that this ordinance or-dinance shall take effect imme. diately upon its passage and publication. Section 11.
