(2) In exercising the above mentioned powers such Board may, in conformity with the nmmsions of the law, reverse or affirm wholly or partly, or may modify tne oraer, requirement, require-ment, decision or determination appealed from and may make such determination as ought to be made, and to that end shall have all the powers of the officer of-ficer from whom the appeal is taken; provided, that before any variance may be granted, it shall be shown that special circumstances cir-cumstances attach to the property prop-erty covered by the application which do not generally apply to the other property In the same district; that because of said special circumstances, property prop-erty covered by application is deprived of privileges possessed by other properties in the same district; and that the granting of the variance is essential to the enjoyment of a substantial property right possessed byoth er property in the same district and vicinity. (3) The concurring vote of a majority of the five members of the Board shall be necessary to reverse any order, requirement, require-ment, or determination of any such administrative official, or to decide in favor of the applicant appli-cant on any matter on which it is required to pass or to effect ef-fect any such variation in this ordinance. Sec. 6. Review by the Court, Any person aggrieved by any decision of the Board of Adjustment Adjust-ment may have the decision of said Board reviewed by a Court of competent jurisdiction by following the procedure outlined outlin-ed in 15-8-104, Utah Code An notated, 1943. Section 7. Special Permits by the Board of Adjustment. After receiving re-ceiving the recommendation, the City Council shall call a public hearing before making us own decision. Both the Zoning commission and the City Council shall keep records of the recommendations of all the citizens in regard to the proposed change, and particularly par-ticularly of those owners of all property within the area included in-cluded within the proposed change and within two hundred (200) feet in any direction of such property. In case of a pro-test pro-test against the change, signed by the owners of at least twenty (20) per cent of the area of the lots included in such proposed change or of twenty (20) per cent of the owners of the area of all the lots within two hundred hun-dred (200) feet in any direction of the property in the proposed change, such amendment or change shall not become effective effec-tive 'except by the vote of three-fourths three-fourths (3A) of the members of the City Council. Any owners of property within the city shall have a right of protest or recommendation rec-ommendation regarding proposed pro-posed changes. (2) Any petition for a change of zoning shall be accompanied by a fee of fifteen dollars ($15) which shall be collected by the City Council and shall not be refundable to the petitioners regardless re-gardless of the decision made, Any petition proposing a change in zoning which shall be unfavorably un-favorably acted upon by the City Council shall not be considered con-sidered upon its merits within one year after date of such unfavorable un-favorable action unless a rehearing re-hearing on the proposed amendment amend-ment is recommended to the City Council by the Zoning Commission. ARTICLE m. DEFINITIONS For purposes of this ordinance, certain words and terms are defined de-fined as follows: Accessorv Livina Quarters: Living quarters within an acces sory building located on the same premises as a main dwelling- such auarters having no kitchen facilities and not rented or otherwise used as a separate dwelling. Accessory Use or Building: A subordinate use or building customarily incident to and located lo-cated upon the same lot occupied occu-pied by the main use or building. build-ing. Alley: A street or thoroughfare thorough-fare less than twenty (20) feet wide. Apartment Hotel: A building thereof designed for or containing contain-ing both individual guest rooms or suite of rooms and dwelling units. Apartment House: A building arranged, intended or designed to be occupied by more than four (4) families. Automobile Wrecking: The dismantling or wrecking of used motor vehicles or trailers, or the storage, sale or dumping of dismantled or wrecked vehicles or their parts. Boarding House or Lodging House: . A building with not more than five (5) guest rooms, where, for compensation, lodging lodg-ing and meals are provided for at least (5) but not more than ten (10) persons. Building: Any structure having hav-ing a roof supported by columns or walls for the housing or enclosure en-closure of persons, animals or chattels. Corner Lot: A lot fronting on two or more intersecting streets, both of which are at least twenty (20) feet wide. Corral: An enclosure for fowls or animals; a pen. District: A section of the city for which the zoning regulations regu-lations governing the use of land the use of buildings and premises, prem-ises, and the area or open space about buildings are uniform. Dwelling: ..A building or portion por-tion thereof designed for or occupied oc-cupied exclusively for residential residen-tial purposes, including one-family, one-family, two-family and multiple dwellings, and boarding and lodging houses, but not including includ-ing hotels or tourist cabins. Dwelling Uni: One or more rooms in a dwelling or apartment apart-ment hotel designed for or occupied oc-cupied by one family for living or sleeping purposes and having hav-ing one (1) kitchen. Family: Any number of individuals in-dividuals living together as a single housekeeping unit, and doing their cooking on the prera- Front Street Line: See "Lot Line Front." Front Yards: For an interior lot, an open unoccupied space between the front line of a building (exclusive of steps), and the front lot or street line extending across the full width of the lot. A corner lot includes in-cludes in addition the area between be-tween the side line of a build-ing build-ing (exclusive of steps,) adjacent adja-cent to the street, and the side line or street line extending the full depth of the lot. Garage, Private: An accessory acces-sory building for the parking or temporary storage of automobiles. automo-biles. On a lot with a dwelling, dwell-ing, a garage shall be considered consid-ered a part of the dwelling if the two structures have one or more walls or a roof in common. com-mon. Where a garage is thus part of a dwelling it shall require re-quire the same side yard as a dwelling in the same district. Where a garage is not a part of a dwelling, it shall be considered consid-ered an accessory building.. Garage, Public: A building other than a private garage used for the care, repair or equipment equip-ment of automobiles, or where such vehicles are kept for remuneration, re-muneration, hire, or sale. Guest House: Living quarters quar-ters within an accessory building build-ing located on the same premises prem-ises with the main building, for use by temporary guests of the occupants of the Dremises and not rented or otherwise used as a separate dwelling. Home Occupation: The use of a room within a dwelling as an office, studio, or work room for occupation at home by a person residing on the premises, but which does not involve the purchase and resale of goods or commodities upon the premises, and where there are no employ ed assistants in any way con nected with the operation of such home occupation. No sign other than a name-plate not more than two square feet in area shall be displayed which will indicate from the street that a portion of the building Is being used for any purpose oth er than that of a dwelling. Hotel: - A building designed for or occupied as the more or less temporary abiding place of individuals who are lodged with or without meals, in which there are six (6) or more guest rooms. and in which no provision is made for cooking in any individual indi-vidual room or suite. Household Pets: Animals or fowls ordinarily permitted in the house, and kept for company com-pany or pleasure, such as dogs, cats, canaries, etc. Interior Lot: a corner lot. A lot other Lot: A parcel of land occupied, occu-pied, or which may be occupied, by a building and its accessory buildings, including such open spaces as are required under this ordinance, and having frontage front-age upon a street or alley. Lot. Corner: ..A lot situated at the intersection of two (2) or more streets, having an angle ang-le of intersection of not more than one hundred thirty-five (135) degrees. Lot, Depth: The horizontal distance between the front and rear lot lines, measured in the mean direction of the side lot lines. Lot Line. Front: The front boundary line of a lot bordering border-ing on the street, and in the case of a corner lot may be either frontage. Lot Line. Rear: A lot line which is opposite and most distant dis-tant from the front lot line. In case of an irregular, triangular or gore-shaped lot, the rear lot line shall be a line within the lot, parallel to arid at the maximum max-imum distance from the front lot line, having a length of at least ten (10) feet- Lot Line, Side: Any boundary boun-dary line not a front line or a rear lot line. Main Building: Any dwelling, dwell-ing, principal or dominating located lo-cated upon a lot, including the following; apartment house, hotel, ho-tel, public building, utility building, hospitals, clinics, mortuaries, mor-tuaries, churches, libraries, museums, mu-seums, clubs, fraternal societies, socie-ties, and similar buildings. Map: The zoning map of Orem City, Utah. Multiple Dwelling: A building build-ing arranged, intended, or designed de-signed to be occupied by three or more families. Occupied: Shall be deemea to include the words "arranged, designed or intended to be oc-cupied., oc-cupied., ' ; One-Family Dwelling) A building arranged or designed to be occupied by one family. Parking Area. Off-Sireetf An open area other than street, alley, or place, used for the temporary parking of more than four (4) automobiles and available avail-able for public use, whether free, for compensation or an accommodation ac-commodation for clients or customers. cus-tomers. Parking Space, Automobile i Space within a building or public pub-lic parking area forthe temporary tempo-rary parking or storage of one (1) automobile. Pen: An enclosure for fowls or animals. Rear Yard: An open unoccupied unoc-cupied space, except as hereinafter herein-after provided, on the same lot with a building between the rear line of the building (exclusive (exclu-sive of steps,) and the rear lot line extending the full width of the lot-Side lot-Side Street Line: The property prop-erty line between the street and the side of the house. Side Yard: An open unoccu pied space on the same lot with a building between the side line of the building (exclusive of steps) and the side line Of the lot and extending from front yard to the rear yard line. Single-Family Dwelling At tached (Row House:) Three or more dwelling units, each hav ing one wall in common with another and containing a single family dwelling unit extending from basement to root. Each such single-family attached dwelling unit shall not have mdre than a basement and two stories, and shall have a front and rear entrance. Street: A public thorough fare or a private thoroughfare, which has been approved by the City Council, which affords principal means of access to abutting property and is more than twenty (20) feet wide. Street Line: The property line between the street line and the lot. Structural Alterations: Any change in the supporting members mem-bers of a building, such as bear' ing walls, columns, beams or girders. Through Lot: A lot having frontage on two (2) parallel or approximately parallel streets Tourist Courti A group of buildings containing individual sleeping or living units, designed de-signed for or used temporarily by automobile tourists or transients, tran-sients, with garage attached or parking space conveniently located lo-cated to each unit, including auto courts, motels, or motor lodges. Trailer, Automobile: A ve hicle without motive power, designed to be drawn by a motor mo-tor vehicle and to be used for human habitation or for carry ing persons andor property including a trailer coach. Trailer Camp: Any premises prem-ises where two or more, automobile auto-mobile trailers or house cars are narked for living or sleen- ing purposes, or any premises designed for such use. ARTICLE IV. DISTRICTS AND DISTRICT BOUNDARIES Section 1. Establishment of Districts. For the purpose of this ordi nance. Orem Citv is divided into seven (7) classes of districts as follows: . Residential District 1, R-l. Residential District 2 R-2. Agricultural District 1 A-l Commercial District 1 C-l. Commercial District 2 C-2. Industrial District 1 1-1. Industrial District 2 1-2. Sec. 2. Boundaries of Districts (1) The boundaries of each of the said districts are hereby established as described herein or shown on the map entitled "Zoning Map of Orem City." or as hereafter amended, which map is attached and all boun daries, notations, and other data shown thereon are made by this reference as much a part of this ordinance as if fully described and detailed herein. The said map shall be filed in the custody cus-tody of the City Clerk of Orem City, and may be examined by the public subject to any rea sonable regulation established by the City Clerk. (2) Where uncertainty exists as to the boundary of any district, dis-trict, as hereby established and as shown on the map, the fol lowing rules shall appiy: (a) Where the designation on the man indicates that the boundary line falls along a street or alley, the center line of the street or alley shall be construed as the boundary. (b) Where the district boun daries are not otherwise indicated indi-cated and where the indications on the map are approximately bounded by lot lines, the near est lot line shall be construed to be the boundary of such district. dis-trict. (c) Where land has not been subdivided into lots and blocks, the boundary line shall be de termined by use of the scale of measurement shown on the map. (d) Where other uncertainty exists as to the boundary of any aisinct, tne Board of Adjust, ment shall interpret the map. (3) It shall be unlawful for any person to erect, construct, establish, alter, move, add to. or enlarge, or to cause or permit per-mit to be erected, constructed, established, altered, moved, or enlarged, or to use or occupy or permit to be used or occupied, occu-pied, any land, building, or premises for any purpose or in any manner contrary to this or dinance. ARTICLE FIVE. USE. AREA. FRONTAGE, AND YARD REGULATIONS. Section 1 Residential District One (Route One.) (1) Use Regulations: in Residential District I, no buildings or land shall be used and no building shall be erected which is arranged, intended or designed to be used for other than one or more of the following follow-ing use: (a) One-family dwellings. (b) Schools; churches, ex cept temporary revival tents or buildings', libraries; museums; private hospitals and all public buildings, except mental or penal pe-nal institutions, provided that such uses do not include a ster-age ster-age yard or repair shop nor emit unreasonable noises, vibra tions, fumes or odors. (c) Public parks; public rec- reatiton grounds and play reation grounds and play grounds, but not including pri vately owned commercial amusement parks or recreation grounds. ( d ) Agriculture, provided tnat no animals or fowls are kept except household pets. (e) Accessory buildings, in cluding a private garage for not more than three (3) cars; guest houses where no cooking facil- titles are provided and where the rooms are not for rent or hire; green houses for private use only, but not as a business; and similar accessory buildings. (f) A signboard not exceed ing eight (8) square feet in area appertaining to the lease or sale of the property, also a bulletin board not exceeding eight (8) square feet in area erected upon the premises of a church or other institution for the purpose of displaying the name and activi ties of services therein, provided provid-ed that such signboard must be set within two (2) feet of the building lines. (g) The office of a profes sional person when located in a dwelling; also customary home occupations engaged in by in dividuals within their dwelling but which does not involve the conduct of business. (h) Accessory uses custom arily Incident to the above, in eluding a name-plate not ex ceeding one and one-half (IVi) square feet in area. . (2) Area Regulations. The minimum building site shall not be less than eight thousand (8,000) square feet in area for each dwelling. (3) Frontage Regulations. Tne minimum width of any building site for a dwelling shall be seventy-five (75) feet at a distance thirty (30) feet back from the front lot line. (4) Yard Regulations, (a) Side Yard. The minimum side yard for any dwelling shall be not less than ten (10) feet and the total width of the two required side yards shall be not less than twenty-four (24) feet. Other main buildings shall have a min imum side yard of thirty (30) feet and the total width of the two side yards shall be not less than sixty (60) feet. Accessory buildings shall have a side yard of not less than one (1) foot-On foot-On corner lots, the side yard which face on a street shall not be less than twenty (20) feet for both main and accessory acces-sory buildings. (b) Front yard. Minimum set-back for main buildings shall be thirty (30) feet. The minimum set-back line for accessory buildings shall be at least six (6) feet in the rear of the mam uuilding. (c) Rear Yard. The minimum rear yard for any main building shall be thirty thir-ty (30) feet. The minimum rear yard for accessory buildings shall be one (1) foot. (4) Animal and Fowl Regu lations; " ' ' i . v i Animals and fowls (exceDt household pets)' shall be prohibited prohib-ited from Residential District 1. Also see Article VI. General provisioni. Section ' 2. Residential Dis trict 2. (Route -2.) (1) Use Regulations. tn Residential District 2, no building or land shall be used, and no building shall be erected which is arranged, intended or designed to be used for. other than one or more of the following follow-ing uses: (a) Any use permitted in Residential District 1. (b) Two, three, and four family dwellings. (c) Boarding houses. (d) Any agricultural use in cluding livestock and accessory farm buildings, such as barns, machinery storage sheds, milk houses, provided that no barn corral, or pen for the housing or keeping of any domestic ani mals within Residential District 2 shall be located, constructed or maintained less than one hundred (100) feet from any residence or dwelling or street line. (e) One stand for the display and sale of agricultural prod ucts raised on the premises. Each stand shall have a set-back from the front street line of at least twenty (20) feet and shall be constructed in confor mity with the existing rules and regulations of Orem City. (2) Area Regulations. The minimum building site shall be not less than six thous and (6,000) square feet in area for each one-family dwelling, and (1,000) square feet for each additional dwelling unit. (3) Frontage Regulations. The minimum width ei any building site for a dwelling snail be sixty-five (65) feet. (4) Yard Regulations, (a) Side Yard. The minimum side yard for any dwelling shall be ten (10) feet and the total wtdth of the two required side yards shall be not less than twenty-four (24) feet, except where said res idential districts have been subdivided sub-divided prior to the effective date of this ordinance, and for such property the least dimen - sion if any such side yard shall be not less than six (6) feet and the total width of the two side yards shall be not less than sixteen (16) feet. Other main buildings shall have a minimum side yard of thirty (30) feet and the total width of the two side yards shall be not less than sixty (60) feet. Accessory buildings build-ings shall have a side yard of not less than one (1) foot. On corner lots, the side yard which faces on a street shall be not less than twenty (20) feet for both main and accessory buildings. build-ings. b) Front Yard. The minimum set-back for main buildings shall be thirty (30) feet. The minimum setback set-back line for accessory buildings build-ings shall be at least six (6) feet in the rear of the main building, except for produce stands which shall have a setback set-back line of at least twenty (20) feet from the front street line. (c) Rear Yard. The minimum rear yard for any main building shall be thirty thir-ty (30) feet. The minimum rear yard for accessory buildings shall be one (1) foot. (5)Animal and Fowl Regulations. Regu-lations. Animals and fowls shall be permitted in this district subject sub-ject to the rules and regulation? of the Board of Health of Orem City, Also see Article VI. General Provisions. Section 3. Agricultural Dis trict 1. (A-l.) (1) Use Regulations. In Agricultural District No. 1, no building or land shall be used and no building shall be erected which is arranged, intended in-tended or designed to be used for other than one or more of the following uses: (a) Any use perm.tt!d in Residential District 2, ?xcett three and four family dwellings. dwell-ings. (b) Any agricultural use, including in-cluding livestock and accessory farm buildings, such as barns, machinery storage sheds, milk houses, provided that no barn, corral, or pen for the housing or keeping of any uumestle animals ani-mals within agricultural district dis-trict shall be located or constructed con-structed less than one hundred (100) feet from any residence or dwelling or street line (c) Dairy farms, fur farms, dog kennels, creameries, grain storage elevators, nurseries cold storage plants, fresh fruit packing plants, livestock, feed preparation or sales, and simi lar agricultural uses, , v (d) Golf courses, cemeteries, radio stations and towers, circuses, cir-cuses, airports, emergency land ing fields, riding academics, temporary revival churches and similar uses. (2) Sanitariums, correctional institutions, and. similar tises. (2) Area Regulations. The minimum building site area shall be not less than six thousand (6,000) square feet for each one or two family dwelling. (3) Frontage Regulations, The minimum width of any building site shall be sixty-five tea) xeet. (4) Yard Regulations, (a) Side Yard. The minimum side yard for any dwelling shall be ten (10) feet and the total width' of the two required ride yards shall be not less than twenty four (24) feet, other main bulldincs shail have a nVnimum side yard of thirty (30) feet and the total Width of the two side yards snail be not less than sixty (60) feet. In Commercial District 1 no building or land shall be used, and no building shall be erected which Is arranged, intended or designed to be used for other than one or more of the follow ing uses. (a) -"Any use , permitted . , in Residential District 2. ( b )i;$et a iiynelghborhood 1 stores, Including groceries, drug Stores, ice cream shops, beauty parlors, shoe repair shops, bar ber shops, professional offices, cafes, service stations for the sale of gasoline, oil and minor accessories only, theatres, florist flor-ist shops, and similar uses char acteristic of retail neighborhood shopping centers. (c) Commercial billboards, electric display or advertising signs. (2) Special restrictions are provided as follows in order to protect and maintain the resi dential character of neighbor hoods in which C-l Districts are located and to develop eco nomic shopping center design. (a) Whenever a lot upon which a commercial structure is proposed to be built Is adjacent to a lot in residential use, or is adjacent to the boundary of a residential district, there shall be provided side yards equal to the side yards required in Resi dential District 2 for dwellings. (b) Whenever a lot upon which a commecial structure is proposed to be built is not ad jacent to a lot in residential use or to the boundary of a residen tial district, no side yards are required provided the buildings are of fireproof construction For other commercial buildings there shall be minimum side yards as required in Residen tial District 2 for dwellings- (c) Front and rear yards for all structures shall be provided equal to those required is Res idential District 2 for dwellings. (d) In addition to the above regulations, the developer of land in the C-l District shall submit a Development Plan to the Zoning Commission showing show-ing building height, yards, au tomobile parking space, loading and unloading areas, architec tural style, displays of signs, and any other feature of design de-sign of such building or grounds which affects the locations, ap pearance, and use thereof. The zoning commission snail approve ap-prove the. Development Plan if it conforms to the use, area yard, and open space require ments or the ordinance, and may make recommendations re garding any other factors of de velopment. Also see Article VI. General Provisions, Section 5. Commercial Dis trict 2. (C-2.) (1) Use Regulations. (g) ; Stores or shops for the conduct of any retail or whole sale business, and manufacturing, manufactur-ing, processing, and industrial enterprises provided that such manufacturing uses shall not give rise to dust, odor, fumes, smoke, gas, wastes, or to danger dan-ger of explosion, or be otherwise other-wise detrimental to a commercial commer-cial district. -: . (h) , Dance ; halls, skating rinks, and other recreational activities. ac-tivities. Ji" (2) Area and Yard Requirements, Require-ments, , - v. (a) J. None for commercial buildings and buildings with fire proof walls and fire resistant roofing, ' ' , Other commercial buildings and tourist courts and trailer camps shall have a minimum min-imum side yard of fifteen (15) feet and the total width of the two side yards shall be not less than thirty (30) feet. The rear yards for other commercial buildings shall be not less than thirty (30) feet. For buildings arranged, intended or designed for residential use, there shall be provided area and yards as though the building were a one- family house in the R-2 Dis trict. ; (b) : Minimum area for tour ist courts shall be 10,000 square feet for a maximum of five (5) cabins and an additional 800 square feet for each additional cabine. 'v (c) Minimum area for trailer camps shall be 10j)00 square feet for a maximum of ten (10) trailers and an additional 1,000 square feet for each ; trailer more than ten. Also see Article VI. General Provisions. Section 6. - Industrial District . One, M.) (1) . Use Regulations. ' In industrial District 1 no building or land shall be used, and no building shall be erected which Is arranged, Intended or designed to be used lor other than one or more of the following follow-ing uses: - - '(a) Any use permitted in Commercial District 2 except as provided in Paragraph two (2) of this section. -(b) ..Any branch of trade employing em-ploying labor and capital in a manufacturing process, except for such uses as are excluded in Paragraph (2) of this section. (2) The following uses are prohibited from the 1-1 District: (a) Any hotel, club, crjurch, trailer camp, or tourist court, unless such uses are incidental to and accessory to, and located upon the same lot or parcel of land as a manufacturing or industrial in-dustrial use permitted in the district. u.(b) Any institution for the care of the sick or wounded, or the mentally infirm, " , (c) ' Dance halls, night clubs, alcoholic and beer dispensaries. (d) Any manufacturing or Industrial establishment which Is obnoxious or offensive by reason of the emission of excessive ex-cessive smoke, dust, gas, noise, or odor, or creates unusuai danger, dan-ger, including the following; , '' Bag cleaning; Blast furnace.
