WITH-jUCENSE. jull be unlawful for any whether as princiya iderk or employee, either LeU or for any other -or for any body corporis corpor-is aa officer of any cor-ja cor-ja or otherwise, to com-s com-s or carry on any business, t, calling, profession or oc-ta oc-ta in this ordinance spec-fin spec-fin Orem City, without i laving procured a license j Bid City so to do, or with- out complying with any otherlicensed and the regulatory ordinances now existing, ex-isting, or hereafter to be adopted adopt-ed by the City Council of Orem City, or without complying with any and all regulations of such business, trade, calling, profession profess-ion or occupation, contained in this ordinance; and the carrying on of any business, trade, call ing, profession or occupation mentioned in this ordinance without first having procured a license from said city to do so, or without complying with any and all regulations of such busr iness, trade, calling, profession or occupation contained in this ordinance, shall constitute a separate sep-arate violation of this ordinance for each and every day that such business, trade, calling, profession or occupation is so carried on. Section 2. LICENSE DEBT TO CITY. location, The amount of any license imposed by this ordinance shall be deemed a debt to Orem City and any person, firm or corporation corpor-ation carrying on any business, trade, calling or profession or occupation mentioned herein, without having a license from said city so to do, shall be liable to an action in the name of said city in any court of competent jurisdiction for the amount of license by this ordinance impos ed on such business, trade, call ing, profession or occupation. . Section 3. License. It shall be the duty of the City Recorder to prepare and issue a license under this ordinance for every person, firm, or corporation liable to pay a license hereunder and to state in each license the Deriod' of the time covered thereby, the name of the person, firm or corporation to whom issued, is-sued, the business, trade, call iing, profession or occupation or place of business where such business, trade, calling, profession profess-ion or occupation is to be carried carri-ed on. All such licenses shall be signed by the Mayor of Orem City and attested by the City Re corder. No license granted or issued under any provision of. this ordinance or-dinance shall be in any manner transferred or assigned, or authorize auth-orize any person, firm or corporation corpor-ation other than is therein mentioned men-tioned or named, to do business without the written consent of the City Recorder endorsed thereon. At the time any such license is assigned or transferred, transfer-red, the person applying for such transfer shall pay to the City Treasurer a fee of one dollar doll-ar ($1.00) for each such transfer or assignment.) The City Recorder shall make a charge of one dollar ($1.00) for each duplicate license issu ed to replace any license issued under the provisions of this or dinance which has been lost or destroyed. In no case shall any mistake made by the City Recorder Re-corder in stating the amount of a license prevent or prejudice the collection by the City of what shall be actually due from any one carrying on a business, trade, calling, profession or oc cupation, subject to a license under this ordinance. Section 4. Time of Payment' All licenses shall be paid in advance ad-vance in legal currency of the United Stales, at the office of the City Recorder. Section 11. Rales of Licenses Established. License Fees: Payable by every person, firm or corporation directly or indiectly dealing in any manner in motor vehicles, oils, gasoline, coal, lumber machinery, equipment, equip-ment, appliances- of every kind and nature, hardware, confections, confect-ions, " lunches, ice, milk, food, bakery goods, groceries, meats, fruits of every kind and nature that are not raised or produced by the. retailer, dry goods, clothing, sport goods, notions, drugs or any other goods, wares or merchandise of-any kind or description, and not otherwise specifically licensed, for each place of business operated, the maximum tax hereinafter pro vided to be paid; provided, however, how-ever, that if any One liable for the tax imposed under this sec tion shall furnish the City recorder, re-corder, on or before the thirtieth dav of the Quarter in which tne fee is due, satisfactory evidence showing the gross amount of cash receiDts collected from sales (excepting sales to the Fed eral Government, its agencies, sales in interstate commerce and wholesale sales of automo-mlps automo-mlps and products manufactur ed in Orem City) by such licen see during the preceding quarter, quar-ter, then and in that case only, the City Recorder shall collect as the tax imposed by this section, sec-tion, 75c on each $1,000.00, or fraction thereof, of such gross cash receipts from sales not ex ceeding such maximum lee, hut not less than $3.00 Der quar ter. (d) Transient auction-house owner. Anv nerson nr anv as. . . i eni, servant, or employee or anv oerson whn shall spII nr nt.l fer for sale at auction any goods, wares, mercnanaise or articles of value in or from any hotel, rooming house, dwelling house, boarding house, store, store room, stall, tent, building, structure, struc-ture, stand or other place indoors, in-doors, or outdoors, within Orem City, and who shall occupy said place for the purpose of conduct ing a temporary business therein, there-in, shall be deemed a transient auction-house owner for the purposes pur-poses of this section; ana the person, or any agent, servant or errmlovpp thprpof so pneaffed. shall not be relieved from the provisions of this section by reason rea-son of association temporarily witn any licensed dealer, traa er, merchant or auctioneer. (e) Charitable or church auc tions The provisions of this ordinance shall not apply to any auction held for charitable or benevolent purposes, or for any church fair, festival nr bazaar. (f) Receipts for Goods, Commission. Com-mission. It shall hp thp dutv of all licensed auctioneers or auction auc-tion houses to receive all articles art-icles which may be offered them for sale at auction, and give receipts re-ceipts therefor; and at the close of any sale, whrch must be made as the owner directs, the auctioneer auc-tioneer shall deliver a fair account ac-count of such sale, and pay the amount received for such articles arti-cles to the person entitled thereto, there-to, deducting therefrom a commission com-mission not to exceed ten percent per-cent on the amount of such sale - (e) Permit to sell, (a) It shall be unlawful for any auctioneer, or person, to sell or offer to sell at public auction in Orem City, any merchandise, or to keep, conduct or operate an auction-house or a transient auction auc-tion house in Orem City for the purpose of selling or offering for sale any stock of merchandise merchan-dise without first obtaining from the City Recorder of Orem City a permit in writing approved by the Citv Council of Orem City so to do. Application for such permit shall be by verified petition, peti-tion, stating that neither fraud nor deception of anv kind is contemplated or will be practiced prac-ticed and that heither the sale, the reasons given therefor, nor the goods to be sold have been, or will thereafter thereaf-ter be fraudulently or falselV advertised or in any way whatsoever what-soever misiteptesented as far as said public auction is concerned; con-cerned; also stating the name of the applicant, his residence, the street and number of the proposed prop-osed place of sale, and shall set forth in detail what statements or representations are to be made or advertised regarding the goods to be sold and the length of time for which the per mit is desired, and whether or not said applicant has been previously pre-viously engaged in a like or similar business designating the place where the same was conducted; and shall set forth a true and correct detailed inventory, in-ventory, listing the articles pro posed to be sold at aie by auction, auc-tion, and giving any identify ing numbes or marKs wnicn may be upon the said articles to be sold and indicating opposite the description of each article, whether the same is new or used, us-ed, and shall list each of the said articles described in said inventory with a number, provided, pro-vided, however, that no articles need be listed in the said inventory in-ventory which have a retail value of less than $5 00. (h) Before any sale is maae at auction, the licensee must attach to each article to be sold, which has a retail value of $5.00 or more, a card with the said number num-ber of the said article endorsed thereon, so that the said number shall correspond to the article, is It is described in the invent ory on file with the City Recorder Re-corder of Orem City as hereinabove herein-above set forth. No article which has a retail value of $5 00 or more shall be sold at said auction, auct-ion, other than the merchandise described and set forth in the inventory on file with the City Recorder as hereinabove required. re-quired. Where a sale is had at public auction of the stock on hand of any merchant or auction auct-ion house, in accordance with the provisions of this ordinance, such sale shall not be fed or replenished. (rt All sales and all persons participating in sales must truly and correctly represent at au times to the public attending such auction the facts in respect to quality. The licensee in each and every case, where an article is sold for $5.00 or more, shall keep a complete record of all such sales made at auction, showing the name and address of each purchaser, a description of each aiticle sold, including the number thereof, corresponding correspond-ing with the numbers shown upon the inventory on file with the City Recorder of Orem City, and the date of each such sale, and the said record shall at all times be open to inspection inspec-tion by the said City Recorder of Orem City. (j) License Not Transferable, Niether the license nor the permit per-mit granted under the provis ions of this ordinance snail oe transferable, nor shall the same be loaned or used by any other person. , (k) Revocation of License. License issued under this Sec tion may be revoked by the City Council whenever it shall have been made to appear to its satisfaction sat-isfaction upon a proper hearing that the licensee has violated any of the terms or provisions of this Section or of tne licen see's bond. Upon revocation of the license, the licensee shall cease to operate thereunder and the unearned portion of the licensee fee shall be forfeited to the City. Section 2. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. Section 3. Penalty. Violation of anv of the provisions of this ordinance shall constitute a mis- demeanor and shall be subject to a fine of not to exceed $100.00. Section 4. In the opinion of the City Council of Orem City, it is necessary for the preservation preserv-ation of the peace, welfare, healtr and safety of the inhabitants inhab-itants of Oem City that this Ordinance Or-dinance shall take effect immediately im-mediately upon its passage and publication for tht reason that an emergency exists in that various var-ious public improvements are dependent upon the enactment of this Ordinance which are intended in-tended to safeguard the health and welfare of the inhabitants of Orem City. Section 5. This ordinance shall be published once in the Orem-Geneva Times, a newspaper newspa-per of general circulation in Orem City.
