Tho act contains other provisions in relation to the manner of proceeding, lue custody of minor children, disttiliu. tion of property, &e. It is claimed on the part of tho that so much of said act as the Probate Courts jurisdiction gives over this class of cases is void, being in violation of the provisions of the organic aot of the Territory; that the remaining lections of the act are valid, and give a right, but fail to create or appoint a tribunal to enforce that right; that therefore the jurisdiction devolves a pcessiiy and right upon some of the tribunals of the country, and tbnt Ihe equity side of thin court is the natural and appropriate tribunal for the trial of divnrco suits. In the United State, jurisdiction in s divorce is statutory. It has been that courts of chancery, however, Lld, in virtue of their inhereut equity powers, lave jurisdiction to declare marriages tiull for fraud, mistake or mental That is as far as cases have been carried. In considering this case, I have separated myself frera all of its surroundings, and I am quite satisfied With my conclusion. There are reasons in thic?
