By a received opinion, by the Supreme Court, Daws vs. Buffington, in which it was held that the salary of a Judge of the State Court is not liable to income tax, has been brought before the Commissioner of Internal Revenue for a decision. It is a very important question as to the liability; other Slate officers have to pay Income tax upon their salaries. The opinion referred to was based, on the argument that if the right of the General Government to tax Judges salaries is once admitted, then the State Judiciary might be taxed out of existence. Other State officers who have appealed from the assessment made upon their salaries, held that the argument applies to their cases, as well as to Judges. The question involved is an extremely important one, as the decision in the cases now pending, being similar to that already given, would probably be followed by demands from all parts of the country for a drawback of all the tax on salaries paid since the Income tax law passed.
