The plaintiffs therefore allege upon Information aad belief, that the derailment of the said engine and train and th. consequent death of the said Frank Neesley waa caused by the neg no-rip- a ligence of the defendant as herein alleged and without any fault or negligence on the part of the w't Neesley.
