Stephens and others was revived la Tha complaint the district court. asks for the issuance by the court of an order restraining tha defendants from accomplishing their threat to enclose a strip of land eight feet wide, extending along the south aide of the Washington school grounds and which is said to be part of the property of that district. A demurrer had previously been Issued denying all the allegations of the complaint but waa overruled by the court. The history of the case, as recounted today, j that on April S7, 19Uo. the defendants, wbo own (he property adjoining the school grounds on the south, constructed a barb wire fence enclosing the land In dispute, which had been used prior to that time aa a play ground. Supt. Allison waa summoned to the scene, who, acting under the instructions of the board of education at once removed the obstructions Mr. Allison testified yesterday that after ha had removed the fence cue of ibe deiendanta, W. J. Stephens, became obstreperous and placed his fist forcibly against the superintendent's nose in order to emphasize his denunciation of the school board. This defendant, he said, asserted that ha would replace tha fence and would maintain his position by force. The obatructlona were accordingly replaced on the following day but were removed by Injunction lsued by the court. Both parties to the case claim title to the property from the same source the Mormon church. The plaintiff aa8t-r:that about 25 years ago Brigham Young, aa trustee, conveyed title to the land to the trustees of the school. According to survey a fence waa erected on tne boundary which haa ever since been used aa a line of demarcation. Documentary evidence waa adduced to substantiate the title and the following witnesses were called to testify that the ground had been in constant use by ' the school since Ita conveyance and that tha boundary had never been changed: Jai.
