The consolidation of the districts on the Wyoming Division o( the Union Pacific railway a forecast in this taper soma days ago took effect this moraing. By the eonsolldation the Ventl1 nd eighth districts, which composed the Wyoming division heretofore have been combined into two districts. As has been stated this change will mean the retirement of Assistant Superintendent Ward from his position aud the new districts will be in charge of Assistant Superintendents H. V Hilliker and Whitney. Heretofore the districts have been from Chey-ento Rawlins, from Rawlins to Green River and from Green River to Ogden. By the change the middle district is abolished and Aasiatnnt Superintendent Whitney takes the district from Cheyenne to Green River and Assisi sntSuperintendentHilliker the district from Green River to Ogden. These changes have been made possible by the immense amount of Improvement work along the road that has obviated many of the curves nod grades. Most of tha heavy grades east of Green River have been eliminated and the doable trick from Buford to Cheyenne has also simplified the operation of traffic. The maximum grade at the far east end of the Wyoming division was formerly 88.1 feet per mile, but the completed improvement work led to the abandonment of the Sherman Hill scent and the trains now pass through cuts and tunnels nt n grade of about 43.3 feet per mile. The construction also of several cut-of-fs between Laramie and Rawlins, and the new line n from Hines to Dana, the const of new lines just west of Green River and the Aspen tunnel tout of Evanston, has shortened the mileage of the road between Cheyenne and Ogden aome thirty miles. Thera la n larga amount of work uow nearly completed in Weber canyon and valley and Echo canyon that will farther abort en time and eliminate grades. All thia hat made possible the combination of district. One effect of the new work la already seen in the handling of traffic Heavier tonnage is ordered used on nil east bound freight train. Tha state supreme court banded down an opinion In the case of H. O. Harknes vs. Commercial National hank of Ogden yesterday afternoon, which will be read with gnat interest ty tha parties interested, by banka and stockholders la banka. The opinion states that the bank mutt permit Henry O. Harkuese, a Stockholder to inspect nil tha hooka, accounts and loans of tha institution. The supreme court by the opinion handed down by Chief Justice Baskin, affirms the decision of the lower court lu granting n writ of mandamus compelling tha officers ot the bank to concede to the request of the stockholder. On Feb. 1, 19u3. Hark ness made a demand upon tha directors of tha bank for permission to Inspect the hooka, which was denied him. The opiulen of the court say a that Harknesa demanded tha investigation "for the purpose of ascertaining the value of hla stock la said bank, and for tho purpose of ascertaining whether tho business affairs of tha said bank have been properly conducted according to law; that loans have been made to a favored few of the h patrona of said bank of more than of tha capital stock to each of said patrons, which is contrary to law, and that he believes the said, directors and officers of said beak have been guilty ot other irregularities which mu only be stated after an inspection of tho hooka and accounts of tho bank." Chief Justice Baskin says the only question involved in tha appeal of the bank officials la whether A stockholder of a national bank, created and controlled by acta of congress, possesses tha same powers and rights of access to and inspection of the books me are possessed by the stockholders of other corporations. Ha holds that the right of inspection is n common law right, and unless restricted by statute or the corporation's charter which is not ao la thia Instance it would ho unlawful to deny Harknesa, who la a stockholder, tha right to make an Inspection for proper purpose, such ns he claims. Ha adds that tha statutes of Utah do not restrict the common law rights, but are in harmony therewith, adding fur- ne one-tent- rui' served- will.-f- o - nt 6:30 NEV jrtarp. ther: The common law right of Inspection by the stockholder fa a personal privilege nriaing from hi ownership of stork of the corporation and can be exercised for any legitimate purpose beneficial to him, without any special appointment for that purpose; but he cannot In its exercise, as tha state, through the medium of tha courts, er a visitor may do, interfere with or direct the general operations of the corporation."
