Mr. O'Neill was arrested upon complaint of H. H. AJbers and Grant gyp hers, who alleged that the defeud-awhile engaged In municipal work. Pad compelled 8. Bowman and Joseph Saunders to labor more than eight hours per day. From the evidence presented It was proved that the two men mentioned worked ten hours per day, but It also developed that they were not engaged in city work, but were employed by Mr. O'Neill on private contract work. As the law does not attempt to regulate the number of hours per day a man must work on private contract, there wasnt sufficient evidence to hold the defendant guilty, and ao he was discharged. In connection with hia city contract work on curbing, guttering and cross walks, Mr. ONeill takes many private contracts and the two parties mentioned in the complaint were engaged on private work.
