Gunnell, John Doe Wright, Mrs. John Doe Wright and Mrs. John Doe Cook wee on trial in the municipal court late yesterday afternoon nnd the decision of Judge Howell was reserved until April 30lh. This action is tbe outgrowth of the actions against Mrs. McKinney, one for forgery and the other for disturbing tbe peace. The plaintiff, Mrs. McKinney, in the complaint, alleges that on the 3rd of March while she was in possession of the premises she then occupied defendants forcibly ejected her from said premises to her damage in the sum of 9HHI and that they are holding the premises unlawfully at the present time, and that plaintiff it deprived of the rent from the premises to the amount of 925. Bkeen A Co., DECIDED The Judgment of the lower eourt In vs. Lizzie Condon, appellant, waa reversed by the Supreme eourt yesterday and the case was ordered dismissed si the cost of respondent. Tbe action was brought in Weber county to compel the performance of a contract of sale 01 some real estate in Ogden. Defendant agreed to purchase the property from plaintiff nnd paid 9100 down on the purchase price. The next payment fell due on October X. 1902, but when the plaintiff tendered the deed to the property on that date and demanded the payment of 9275 which was then due. defendant refused to accept the deed or to make the payment on the ground that there was a mortgage on the property which had not been eatisfled. Suit waa brought to recover the amount of the payment and the court below rendered Judgment in favor of plaintiff. The Supreme court bolds that this Judgment Is erroneous for the reason that e vendor cannot demand payment nnder a contract of this nature until he has tendered a title to the property free from Incumbrances. The Judgment la therefore reversed as stated above. McKinney, charging her with forgery committed on November 30, 1903. at which time she is alleged to have forged the name of Elizabeth Billings to a warranty deed.
