VALIDATING The Salt Lake Tribute, in publish ing the "Sill to Validate Divorces," how pending before the Legislative Assembly, is greatly mistaken in supposing lhat Judge Williams was its author, or that it is for his benefit. We know personally that Judge Williams don't care a fig whether the bill be enacted or not, nor is he in any way dependent on it for any legal right, nor indeed can that law, if enacted, secure to him any legal right ef which he is not now fully possessed. .So if the Tribune wantf to can , oppose the bill on its merits he that fear of the extraneous do so rid it might do Judge Williams some good. The bill should stand or fall on its own merits or demerits. On March 6, 1852, the Utah Legislature enaoted a divorce statute which remained on the statute book in full force until a new law was enacted by the Territorial Legislature February 2, 1878: This divorce statute in the meantime had been presented to the Congress of the United States on three several occasions, at least, and had never been disapproved by it, thus the Territory and United States stood actually or tacitly pledged to its validity in all its provisions, but after more than two thousand divorces bad been granted, involving innocent men and women all over the United of ,. States, the State courts, partaking the prejudices of the day against everything pertaining to Utah, teemed to take especial delight in proclaiming the divorces granted under this statute as null and void, and . imprisoning and otherwise punishing those who had availed themselves of the privileges of the statute. In many of the States, statutes have been enacted similar in their provisions to this proposed one, conferring upon their courts jurisdiction and authorizing their citizens to bring such suits. Without Bome such statute the courts have no jurisdiction and there is no remedy by which the validity of a marriage subsequent to such a divorce, can be tested, consequent ly our law of divorce has been and will continue to be construed by the prejudiced tribunals of the other States. But as every well read law yer knows, the supreme ceurt of the United States has decided that when the courts where the divorce may be granted upholds , their validity, they are then "valid throush the United States, by virtue of that clause of the United States Consti tution which gives the same effect to all records and judicial proceedings throughout the United States, as they have where rendered. It is therefore a simple question of moral obligation and of policy whether our legislature will give a remedy in the forums where the statute was per mitted to stand for more than quarter of a century, er will it, after involving so many hundreds of people, through its legislative enact merits aud through its courts, leave them to the tender mercies of other ferums, or give some small reparation lor this great injury by giving remedies in our own country. Be- ides, we are but pursuing a gener ally adopted policy, wise in itself, ol having our laws construed by our owa courts instead of the courts of other and hostile States.
