Saturday Evening, February 14, '74 TERY IMPORTANT TEST CASE. A most important decision has just been rendered by the United States Supreme Court, regarding tie liability of railroad companies, where bodily injuries are inflicted through want of ordinary diligence. The decision is rendered still more noteworthy from the fact that it is the first case of the kind that has been adjudicated by the highest legal tribunal of the country, Numberless instances hare occurred, and are of constant occurrence in which the principle of the accountability of companies for fringed all around with dead weights, will not attract currency. It will refuse to move in such directions. Congress may legislate into existence a hundred millions of new paper, but without a corresponding movement of industrial enterprise, the amount will find no use save in promoting and producing the very evils which are sought to be averted. We maintain that an increase of volume over the wants of general business, means depreciation. An immediate return to specie payments means a collapse. What is wanted is such a currency that shall be on a par with specie which shall be convertible, flexible, and adapted to the various conditions of commerce and trade. As yet no measure has been introduced in Congress to meet these requirements, and as a consequence, are at sea, drifting our without along compass, without fixed prospect of reaching dry land. law-make- rs OX Til E WA K 1'ATir. The defence alleged as a plea, e that the was on their own and the complaintherefore premises, ant was a trespasser. The jury rendered a judgment against the Company for $7,500. An, appeal was taken to the Supremo Court on a bill of exceptions, and that body affirmed the judgment of the Circuit Court, also allowing interest and turn-tabl- costs. ' The effect of this decision will exercise a most salutary iiiflueneo, in compelling common carriers and individual companies, to adopt necessary safeguards against the numerous casualties which arc daily recorded. It establishes the fact, that they do not enjoy immunity from the strictest obligations in guarding against the possibility of accidents which may result from their lack of precautious and extraordinary diligence even on their own premises.
